If it was an advisory last time and they are no louder, it should be the same this time.
DO remember that pipe loudness is in the oppinion of the tester though. I would personally come down hard on harleys with screamin' eagle pipes because they've been taking the piss for far too long while other bikers are penalised or fined for rediculously loud pipes.
The rules state they should be no louder than the standard exhaust on a bike of a similar type.
So you're lucky I'm not an MOT tester because I'd make you either fit a baffle or go home and change them for standard ones to pass the MOT like I've had to do for years with my sportsbikes.

Isn't there something age related as well?
My old Z750LTD was a US import and it had virtually straight through slash cuts on it, which were ridiculously loud at anything over tickover.
When I got it tested, the guy said he couldn't fail it, because it was too old (1980) so he gave me an advisory. ____________________ Things get better with age; I'm close to being magnificent........

It should be quiet enough to have the E mark (assuming it is for the silencer, not E marked as something else totally random). In theory the baffles should not be removable (and Akrapovic put a tiny spot weld onto the bolt holding the removable baffle in so it strictly speaking needs to be broken to remove the baffle), so removing it means modifying the exhaust to be noisier. Which is in itself an offence.

Only if the exhaust is road legal, and a dealer selling new bikes fitted with illegal exhausts is on fairly dodgy ground.
Likely the Akrapovic exhausts have a legal baffle fitted or are officially supplied without being fitted to the bike.
Exhaust rules have changed loads over the years and are now hideously complicated while they try to not contradict previous laws. These days (and since the mid 1980s) there are specific limits on how loud the exhausts can be, with standards for how this measured (and not some dodgy check at X rpm with a meter vaguely Y cm from the end of the exhaust). If they are not this quiet then they are not legal, so a noisier exhaust from new just makes the new bike illegal.
That said, construction and use rules are rather different to the MOT rules.

Had an advisory on the Bandit with the Beowulf can last time, even with the baffle fitted.
Will be interesting to find out if it happens again when the next one is due ____________________ 1st bike (Sept'06 - May'10) : 1991 GPZ500S / Current bike (since Nov 2009) : 2003 Suzuki Bandit 600N

My bike has sounded biblical for years. Wire wool wedged down the spot with a broom handle... ride to centre gently.
