I have a Yamaha Sr 125, I was hit from behind at the amazing speed of 5mph, stayed on fine and this seems to be the only real damage. Tail and brake lights are all fine and the wheel spins straight. All I'm thinking is, is it worth going down the route of getting it fixed (they agreed to pay for damages & I have a witness). A small part of the holder has come off and doesn't seem to be causing any problem, is this something which needs fixing or can it just be left and forgotten about if when I get the bike checked over this is the only damage.

Get it checked out professionally at the 3rd party's expense whether that be settled privately between you or through their insurance.

If something has been damaged then they should cover the cost of getting it fixed.

I was taking my bike in tomorrow to get a new rear tyre anyway, will they charge to check it over? And what happens if he refuses to pay the money for the check

If the 3rd party refuses to pay then you notify your insurance company and pass on your his details.

I'd be trying to avoid the insurance route for such a small claim but it's there as a back up if needed.

You could always get a quote for it to be fixed, show him the quote and get payment before any work is done. Whether then you bother to get it fixed and spend the money on beer instead is up to you Wink

They won't pay out for you to have it checked over if it turns out nothing is wrong with it.
But if you're having a new tyre anyway I can't see the shop charging you for having a look while the wheel is off plus when they refit the wheel they should check the wheel alignment anyway and it should be obvious if anything is bent swingarm/shock wise, if there is going to be any damage it's going to be there.

looks like for a very small amount which insurance will raped you the next quote, even if it isn't your fault they still bump up their prices!
