Thought you may be interested in this as one of the many gripes made by claimants and defendants alike in road crash cases is that the only people who seem to make any money are the Solicitors.

About 12 months or so ago, fixed fees were introduced in lower value end claims, well these fees are to be reduced again.

The chances are that before long, smaller or lower value injury claims will only be handled by insurance companies as there will not be many law firms who will be prepared to take on cases where it might mean that they cannot represent the client properly, or they will be handled by non qualified staff (which is already starting to occur)

For the purposes of clarity, the proposals are that fixed fees in portal cases are to be allocated as follows:

RTA claims up to £10,000 - £500 in total fees

EL/PL claims up to £10,000 - £900 in total

RTA claims between £10,000 and £25,000 - £800 in total

EL/PL claims between £10,000 and £25,000 - £1,600 in total

EL/PL stands for Employer Liability and Public Liability for those who were wondering.

In other words, solicitors will push 'victims' into hamming up their injuries even further in order to get past the thresholds :)
At least _something_ is being done though.

Or will say "Sod it, 50/50, we don't have the budget to argue it out. It'll all come out of the punters pockets' either way."

No, if you read my post all the way through all, what is likely to happen is that there will be fewer and fewer firms handling not just personal injury cases, but lower value cases, or they will go down the route my firm has taken and only handle the serious and catastrophic cases, and/or the claims will be dealt with entirely by claims management firms or low qualified legal people who will run the conveyor belt system.

Cases have to be risk assessed, especially in no win no fee funded matters, and the medical evidence has to be supportive, so with the exception of the soft tissue injury cases such as whiplash and similar, it is quite difficult to big up the injuries anyway.

This will result in cases being undervalued even more so than many are now, and you will have less choice of legal representation because you will not be able to get funding under a CFA.
