ok, so I just got this letter with the scary bold "DEBT COLLECTION" title on it, and naturally phoned up MCE to find out what the heck was going on. It turns out a payment didn't go through in November. Apparently they had phoned me and left a message but I've not got any unread messages. I asked them for the number they phoned and it wasn't my number. Not even one i recognise. There were letters too, but this is the first one I've seen about it.
What scares me, is that apparently the insurance was cancelled on the 8th Dec. because of this, and I didn't know about it. I explained all this to them, and I've got to write to them explaining it again to dispute the charges. The debt collection letter I got is for admin and collection, nothing to do with the actual cover itself. Now form what I understood of the call, they could pause the 'debt collection' process and remove the £36 recovery fee, but the £32 cancellation fee still applies apparently.
I'd like to contest the cancellation fee as I wasn't aware the policy had been cancelled in the first place, but where do I stand with all this? What exactly can I do about it, what is likely to happen and what are my legal rights with this whole situation? I'll be looking through as much info as I can find, but if anyone could offer advise or information I'd really appreciate it.
I've had to buy a new policy (went with Carole Nash) as I can't be uninsured on the bike, but I'm not sure if/how that would affect this current predicament. It's already screwed me over as I'm on JSA and I'm now skint. Oh yeah, 5 days till Christmas; merry fucking Christmas MCE you bastards.
I feel like just selling the bike and saying bollocks to it all. ____________________ Current: VFR800 2008 13.7k and rising rapidly!

Well 1st thing do you not check your bank statement to ensure that any payments have been made.
I think you will find that its clearly stated that any missed payments will incur charges. And failure to ensure prompt payment will mean your insurance is cancelled.
I hope that when you set up the new insurance that you ticked the box for have you ever had ins cancelled..... Or you could well end up with this cancelled or further charges advised, as the cost will go up..... ____________________ Just because my bike was A DIVVY, does not mean i am...... |

And you've only just noticed that you'd run out of money and were getting raped even further into debt by bank charges?
Everything comes down to whether that payment was taken or not. Go and find out.
If the payment was made on time, then tell them to shove it and compensate you.
If it turns out that payment was rejected then I suggest that you suck it up, pay MCE, then tell Carol Nash that you've had insurance cancelled and prepare for another shafting from them.
If you can't afford that then yes, sell the bike. You're on poverty money, a vehicle is a luxury. If you're out in the sticks then see if your local Job Centre can sort you out with a vehicle to get you to interviews and work, some of them do. ____________________ Biking is 1/20th as dangerous as horse riding.

Well given they seem to have a wrong tel number, you have to wonder if the bank acc is correct.
Was it set up over the phone ? Where there is scope for miss hearing.
Have you recieved any doc's from MCE. Given that they were taking payment via DD. That means you are paying monthly and as such have entered a credit agreement that requires signing....
Contact your bank, they will be able to confirm if DD has been requested/set up and if any requests were made for funds.
If its not. Then you need to raise a complaint, with MCE and be prepared to take it all the way to FOS. ____________________ Just because my bike was A DIVVY, does not mean i am...... |

Ah, got you. Well, it sounds like you've been properly stitched up by yet another cloth eared phone-mong. Aside, this is why I absolutely insist on typing in all my details myself.
I agree with iooi - get back on to their complaints department and tell them that their choice to employ some prat who can't listen or set up a DD is not your problem, and they need to sort it out. ____________________ Biking is 1/20th as dangerous as horse riding.

Thanks for the replies folks. Looks like I'm going to have to check through everything which is a complete pain in the arse right now. Especially as I've had this stinking cold for the last few days and I was exhausted this morning. Damn man flu. ____________________ Current: VFR800 2008 13.7k and rising rapidly!
