So here's the rundown
*Brothers bike broken.
*Brother takes my bike.
*Brother lends my bike to his friend.
*His friend gets pulled over for cutting MARKED UNIT up on a roundabout.
Transpires friend does not have FC ins entitled to ride other bikes, now I turned up V5, licence and ins in hand and now being told recovery truck already been called and cannot take my bike home.
"Friend" was marched home by me and his mum is paying recovery fee etc, however I know have to stand in court to explain why I let him ride my bike!! and why I shouldn't get 6 points!!
Anyone, help and opinions... anything.. please?  ____________________ Bikes (Not Bikes Really Just Shitty Mopeds)

^ What he said, 3 options the way I see it;
1. You tell them you gave him permission, you get 6 points, you stay friends, but your insurance is ruined for the next 5 years.
2. You get him to admit to the court he rode the vehicle without the proper insurance cover, he (rightly) gets 6 points, learns his lesson for being a tit, you might stay friends depending on how he accepts you won't take his shafting for him
3. Grass him up, tell the police he took it without your consent (technically correct, you never gave permission, your brother did) he gets shafted big time, not only for no insurance, but for TWOC. Since I am going though the Special Constable application and know a fair few serving officers, I can tell you with 100% certainty that in his PNB is something along the lines of:
"Name: Connor Xxxx, friend was pulled for careless driving, found to be driving uninsured, motorcycle is owned by aforementioned. Connor stated that he gave the suspect permission to ride his motorcycle".
I guarantee you if you said that to an officer that it has been noted down, so if you do turn up to Court now and say that you didn't give him permission, the officer will show the Judge that note in his PNB and you are likely shafted.
This will teach you not to loan your bike out, especially to people that seem to be careless idiots who don't give a flying fvck about you.

Not the best situation to be in really, 5-0 operate on a 'no takesie backsies' policy, if they've written it down that you said you said it was ok for him to ride it'll likely come up in court if you then deny it, and could amount to perverting the course of justice or something (you told them that to stop him from being nicked, when really he should have been)
You could try to argue in court that he had told you he was covered under a FC policy, it would help if you had a witness (your brother might want to help you out, seeing as this is partly his doing) but they might point out it is your duty to make sure that anyone using your vehicle has the appropriate cover.
TL;DR
Take some lube and something to bite down on, you're probably going to need it.

Your brother borrows your bike. He then lends it to his mate who has no insurance, without your knowledge. You then claim to the old bill that you let him do it, and you're the one responsible.
How i would have dealt with it:
My brother borrows my bike, He then lends it to his mate who has no insurance without my knowledge. I then tell the old bill i had absolutely no idea he was going to do anything like that, i'd loaned the ped to my brother for the night. I wait for his family to pay to get my fucking bike back and then i hospitalise my brother for being a thick cunt. I wait till the old bill are through with said thicko mate/partner in crime, and give him the same treatment. Neither of said dickheads goes near my bikes again. They dont touch, breathe on, or so much as look at my bikes. EVER, EVER again.
And if im to be completely honest, at the point they got a bike of their own, i'd make a big deal of borrowing it, and then ragging the absolute fucking shit out of it till it blew up and then returning it claiming "it's not that bad...least its not in a police impound yard eh??"
But then me and my brother dont get along too well...
But seriously, what the fuck were you thinking about telling the old bill that you let them do it?
Changing your statement is technicly perverting course of justice, both of which wont look good when it does go to court. If you get the points, you deserve it for being a fool!
You will then suffer MASSIVE insurance premiums for the next five years or whatever it is...so when you get that car aged 19? 20? your £2500 bill is now £3500. So really, you'll be costing yourself a shit ton of £££££ over a lengthy time. And all those jobs requiring a clean licence? forget about em!

Just to offer an opinion I'd never lend a bike to anyone as the multitude of different shit which could be thrown back at you as a consequence (even if they were properly insured, licensed etc) could be a major pain and unless you have total trust in them to take responsibility and own up to anything they do on it you're the one who will be shafted.
People don't treat other people's vehicles the same way as they would their own just as a start, its an opportunity to play around for them hence your prick decided he was going to merrily cut up a police car on a roundabout!
Its your bike nobody elses and you need to take responsibility for it, as soon as someone else is riding it you can't!
I think telling the police that you had given the guy permission to ride your bike was the worst thing to do. |

Simply state that he told you that he had insurance to ride it. He might not back that statement up and if he doesn't, he deserves a kicking. And if he does back that statement up, you'll get off ok. Like I did. |

Well, you're a daft prat, but that goes with the territory, and your brother's "mate" is far worse. He was riding it like it was stolen, because it was stolen.
You are being properly stitched up by this "mate", so explain to him clearly that the only reason he's not being prosecuted for TWOCing it is that you've screwed yourself by covering for him.
What you'll want to get him to do is put in writing that he assured you (not your brother, don't change your lies now) that he had 3rd party cover and sign it, one copy dated today in the past tense ("I told the daft prat I had insurance...") and one in present tense back dated to before he TWOCed it ("You daft prat, I have insurance...").
Then you go down to the cop shop and plead your case. If if it's already been passed on to the CPS, then just sit tight and wait for the summons.
If you're summonsed, speak to a specialist motoring solicitor. Explain your story - whichever one you settle on, but do not change it again - show this "mate's" statements and ask whether in his experience the RTA 1988 Section 143 3 (c) defence applies to a 1 (b) offence.
Considering that you're likely to lose your license over it - new drivers act, right? - as well as get an insurance raping of cosmic proportions, do not just plead guilty then spend the next 5 years pissing and moaning about the situation. Make the prosecution prove their case.
Weigh up the costs of professional representation versus arguing this yourself. Don't be shy about contacting the CPS prosecutor directly before the court hearing, citing the RTA as above and explaining that you have a signed statement and that the "mate" is ready to swear to in court (bet he won't though) and see if they drop it.
Ask again at the courtroom door.
And I guess you already know, but anything that you say to a copper can and will be used against you. Least said, soonest mended in future, eh? ____________________ Biking is 1/20th as dangerous as horse riding.
