I think the answer is that you can, but if you have any sense, you won't.

Actually I'm fairly sure it's illegal as a pillion can affect the bike quite a bit so they should be sober.

Having done a quick google there doesn't appear to be a law directly against drunk pillions, but if they are so drunk as to cause a danger either by not being able to hold on properly or by being a distraction to the rider then you could be charged with dangerous driving. All according to google.

Well, the specific evidence in this thread suggests that if you're an idiot, you will. Wink

I agree that there's no specific law prohibiting it. There's no law specifically prohibiting undertaking either but you can still collect points for that.

Why do you ask? If you need legal advice after the fact, PePiPoo or a specialist motoring solicitor would be the way to go. If you're thinking of doing it, well, look at the company you'll be in. Tut Tut

I have ridden with my pal drunk on the back of my bike countless times. Nothing wrong with it, he was perfectly safe. Much safer than many sober people on the back of a bike.

If it's someone who can't handle their drink and don't have experience on bikes then yeah its probably a bad idea. Nothing wrong with experienced pillions that can take a few drinks and still be reasonable.

I went pillion whilst at the last BCF BBQ because I had drunk far too much to ride with the others on the ride out, forget whos bike it was now........ Aprilia 1000.

I was okay on the back and the rider said I was no problem.

There's a difference between "has had a few too many" and "drunk" imo. Someone who'd had too many to drive, but was still compos mentis I'd probably give a lift. Someone who's drunk, no way, it's not safe for me, them, and most importantly, my bike Shocked

No specific offence but if they are too boisterous you could get a CU50 - Causing or likely to cause danger by reason of load or passengers.

Giving a lift to a drunken pillion can be quite a daunting and stressful experience so I tend to have a few drinks myself beforehand. Just to steady the nerves you understand.

My ex used to get on the back drunk. Shame I never lost her off the back.

It was my friend's birthday not so long back, and she was probably the most drunk person I've had on the back - she'd just been on a bar crawl, so was quite drunk. She's a biker and has been pillion before so I just told her to stay still, all good.

I thought there was some sort of precedent where it was proven that a pillion passenger has a material effect on the handling of the vehicle.

I thought it was OK for a pillion to have a couple of drinks, but it was seriously dodgy legal ground to take one that was drunk.

All the law states is that any pillions carried must be capable of sitting astride the machine with both feet on the footrests and must wear an approved or suitable helmet.

They can face the wrong way if they want to (not advised) and there is nothing to prohibit the rider carrying a pillion even if that pillion is drunk.

However, the issues only arise if that drunk person interferes with the control or operation of the vehicle (regardless of whether they be in a car or on the back of a bike), and it can leave the rider as well as the pillion open to prosecution if their control, safety or actions are compromised because of the drunken state.

I think TC sums it up well.
One of those things you have to assess 'on the spot'.
I've had 'inebriation' passengers before, in a car or on a bike.
A Drunk Back-Seat Driver waving arms around trying to change a cassette or prodding at buttons in a car, is probably MORE of a distraction/danger than some-one ' a bit squiffy' on the back of the bike... WHERE actually, cold air and shear fear CAN actually sober them up VERY quickly, and they 'pillion' better than when sober!
OR as one 'mate' managed... just slumped on my shoulder and passed out! Normally he was a pain to pillion, he'd try leaning the bike over for you, as you tipped into a corner, then try picking it back up when it started to go.... on that occasion he was teh perfect passenger.... a sack of spuds!
Getting him off at the END was rather more interesting!

I agree, in fact they don't even have to be drunk, just annoying tits.
One girl in my friends car in the back seat wouldn't put her seatbelt on and slapped him in the back of the head while he was starting up the car, so he drove slightly and slammed on the brakes throwing her forward into the seat and making her about shit herself.

Needless to say, she put her seatbelt on.

Possibly rules governing Insecure Load would cover it.

Same applies when bursting for a poo on a 15 mile commute.

Or that would be Without Due Care and Attention.

I suppose its the same as taking a 5 year old on the bike.

Im sure if they can touch the pegs its legal, but in reality you wouldnt, which makes me laugh as now days a child cannot sit in the front seat of a car, only the back in a proper child seat.

Seems a bit crazy how you can get fined for a child sitting in the front of a car with no child seat, but can go on the back of a 1000cc superbike legally.
