Hi all, got a letter today from my solicitors about my crash I had last June.

All court docs are settled etc, just waiting on a date. Turns out the other side have offered 50-50. No witnesses either side.

My claim is worth around £4k, her counterclaim is £400.
So obviously if I accept the 50-50 I'll just pay my insurance back 200 quid to get my 3yrs NCB.

But that they are offering to settle now before going to court surely says that they are worried they might lose so are cutting losses? Therefore it might be worth me pursuing it more to get 100% or as close to it as possible?

I'm not in a bad position for the money if I'm honest. The having a fault claim makes a negligible amount of difference to insurance compared to having 3 years NCB. I'd happily lose out on 2k to get it settled now so I could buy a nice bike for summer.

Thoughts?

Think about it...

Was it your fault in any way, would you consider it your fault at all?

If not, fight it.

If YOU think you might lose, you can choose 50/50... unsure how that works with no claims though..

I didn't consider it to be my fault, but TC and everyone on here reckoned 25% lay with myself. The girl is young and pretty.
It might take another age to claim and 2k isn't that much to worrry about the hassle tbh. Taking time off work, planing holidays around court dates and missing out on the short summer is worthwhile me taking that cut in my head.
I've only just read the letter after office hours are shut, I might push for a 75-25. Don't know really.

If you can do 75/25 you can do 100/0

I had a case where the woman contested I was speeding and at fault after I rear ended her.

She has reversed out of her drive on a major road, 0 witnesses, I won.

You sure about that? If you've accepted half the responsibility how do you expect to keep a discount for not having any claims?

Maybe discuss with her lawyer the possibility of accepting 100% fault if she'll let you up her gary? Do you have legal representation that could fight for this on your behalf?

Yes I am sure. It's quite common. Have already checked with my insurance and they'd be happy to do this.

Pendulum, had many days in court, victory is never so sweet. It's hassle, and generally a bit ugh.

Tommy, I wish, shes connected on facebook by a few friend of friends, maybe afterwards I'll ask her out for a drink hah.

Really Really sure? I only got my NCB back 'cause I won 100%. Surely if people could simply buy their bonus back it defeats the point of no CLAIMS :S.

And her hotness is a serious consideration, Magistrates are mugs for a good sob story.

Any liability your way and you've got an "at fault" accident to decalre, regardless of whether you can do some voodomaths to retain a "no claims" discount.

Hi, Insurance company here, accept 50/50 and we will payout £2200, of which you will payback some of it to us. This saves us paying out £2k minimum on lawyers fees to take this to court, and also messes up our working relationship with our "competitor" who is probably sharing the underwriter anyway. So essentially "underwriter" will payout 2xlegal fees and the insurance repairs.
But work with us and we will ensure your paperwork states 5 yrs ncb, but will show a fault claim......you know its for the best.

While I see what you mean, for me currently, it seemedly would be the best option. In all likelyhood going through the long court process would end up in a similar result.

Going to discuss with solicitor tomorow but probably will accept 50-50 if can't push for more out of court.

I am in a situation similar to yours at the moment, in my accident in October 2009 the bloke that left the junction is adamant that it is not his fault and loads of other stuff.

Anyway, my solicitors got a legal opinion on it all and they said it would likely go 50/50 with the main thing pushing it in my direction fault-wise is speeding, but not only is there any proof I was speeding I also have the testimony of Doctors stating that if I was doing above the speed limit I'd have died, so this is going to Court and I am going to have my day in Court and I will fight my ass off to get it 100% his fault because that is what it is.

Just go for it and fight it, have your day. Thumbs Up!

Same here, I wasn't at fault and the other driver is claiming whiplash. All the evidence stacks against her, drove off whilst I had to chase after her, she was speeding and ran a red light. I even have a witness, and in her police statement she said she thought she ran over a pothole.

Still going to go 50/50, and tbh I can't fucking wait for it to all be over, insurance is a complete scam and shambles.

Right, well due to a balls up with my solicitors, it seems her claim is for 1400 plus costs, so I'll be fighting it in court instead of rolling over. However looking over the figures, the other side have valued my injuries (which were very minor and I said so in medical) at around 3k more than my solicitors did.

So that extra 1500 quid would cover the hike in insurance to settle today and have the money.
