Hey guys, this my first ever collison with a car have been riding for 4 years, so i have a few questions in regards to insurance and the way i should deal with them, hopefully you will help me out in this situation and explain a bit further, i will appreciate it alot!
The story is straight forward as i left my house, i came to a junction, it was clear and as i went onto the main road, from the right also a junction a mercedes driver took me out as he was coming out onto the main road, he didn't look and went straight over withouth hesitating to even look straight forward! As he knocked me over he didn't stop at the incident but went to the end of the road and parked his car, without having any concerns over me and my condition! As he approached me there were a few motorcyclist that gladly helped me out, plus the car behind saw everything and said she would be a witness as he is at fault, he also was more concerned about his little scratch on the bumper, whereas my bike had cracked panels, bent handlebars, levers, gear selector, brake pedal, the front cowl moved out place cause of the snapped mountings!
So now i talked to my insurance company paid administration fees as i am with tp only! I also got a call from the guys insurance, that apologized and said that they will happy deal with it directly, without my company getting involved, plus they will pay back administration fees,repair work, and my no claim bonus would not be effected, i also asked if that guy accepts that he is at fault, and they said that they already told him that he is at fault and that i am not to blame! So the questions is how should i deal with this matter in addition should i get an estimate on damaged parts from local honda dealership and what about personally injuries, i think i might have a broken thumb and brused leg? any thoughts or experience... will be happy to hear it i am new to this!

Sorry to hear you got knocked off, I hope it's going to be added to the BCF spill counter
If you think you may have a broken thumb, get yourself to the hospital immediately to get it checked, confirmed and treated. Inform their insurance of the injury.
It's been a LONG time since I had to claim on insurance but pretty sure getting an estimate of repair costs from your Honda dealer is the way to go. Ring his insurance and ask them exactly what they need from you.

Your neck hurts. You should go to the doctor, then the hospital later on when it hurts more.
Your thumb hurts, as does your wrist. Perhaps its sprained, you should tell your doctor that the paracetamol/ibuprofen isnt working. I think you might need stronger painkillers and muscle relaxants.
I also belive you're struggling at work and are on lighter duties...and there was that time you had to take off wasnt there. Due to the meds you cant drive, so theres always the public transport costs.
Should be at least £3-4k there if not more. Use the free physio to sort out any old back injuries you may have had... Never accept the first offer. Same goes for what they offer when the bike is written off - offered to pay out £500 on it, and eventually gave me £1100 for it. Id paid £800 for it in the first place. Print off the most expensive ads you can find for your bike. ____________________ Please be aware that the above post may be full of complete nonsense.

The premiums are high because of the stupid people on the road that can't be bothered to look twice, that don't give a sh*t about the people on motorbikes and in general, they think its a joke, i could of bloody died, do you think i wanted to claim? I didnt know you get paid for the damage on TPO even if the other guy is at fault.
TPO means that if you are at fault, your insurance covers damages to someone else but not yourself right? And obviously not covered for fire or theft. Shows what i know about insurance  ____________________ To shreds you say? Tss tss tss |

You know what, the other guys insurance so far have been more than fair. They accepted full liability and seem keen to help. Now they may have their own interests at heart wishing to avoid ambulance chasers and the such like, but so far they seem to have been helpful beyond their remit.
Then you get twats advising injuries are fabricated, a simple low value claim becomes a litigation nightmare with no one but lawyers benefiting.
These twats are the ones who drive insurance costs up, pricing out the young etc.
An insurance claim should leave you in the same position you were in before the claim was made, with possibly a little to cover things that cant simply be repaired.
So far his insurance company has used integrity.

My advice is to legal advice (and no, not from your insurer, or anyone they've appointed for you) on how to handle this properly, particularly where injuries are concerned, to ensure you don't end up out of pocket when this seemingly 'helpful' insurance company try to diddle you at a later point in the process, using some obscure point of legalese. This will cost the other insurer more but will protect your own interests, as the way the system works means that you're personally no worse off by getting the help, but potentially could mess up your own case if you try to DIY it or relay on the 'conveyor-belt' style firm your insurer would appoint.
So ideally find someone who's a specialist in the type of law you need, and approach them to see if they are interested in your case (Hint: Firms who advertise on TV for general purposes aren't really the types you want - you want a motorbike specialist if you can find a decent one willing to take you on).
NB: Make bloody sure it's no-win no fee and that you're not liable for charges - read the small print. (imo trusting what someone says on the phone is very dangerous considering the sort of figures you can be on the hook for when you sign your name).
Note: If someone's already dealing with it, make sure you read what you've already signed/agreed to. If in doubt, get advice on it from the new firm. And no, you definitely don't have to keep to the original firm dealing with it!
And just to make it clear, i'm not an expert on this topic, i've just read a hell of a lot of posts on here over the years, including those from the guys who work in the legal sector. ____________________ -- Ingah |
