Last month I purchased bike insurance from MCE Insurance. It seemed a good deal and I even got an Alexander Meerkat toy for my troubles.

A week ago they rang me and asked if I had all the documents I needed. I had received the policy, schedule and certificate of insurance by e-mail so I said that I had.

Today I received a letter with a copy of a credit agreement in. This is the first postal correspondence I have received from MCE. It exhorted me to sign the credit agreement and send it back to them. It also said that I was being 'fined' £12.00 for not having sent it back to them before and that this would be taken with my next direct debit.

I contacted MCE to be told that they had 'proof' that I had received the initial contract that had been sent to me, as I had said that I had in the phone call. They have refused to refund the £12.00 on this basis, in spite of the fact that I never received the first letter and was not referring to the postal, but the email correspondence when they rang.

How can they have the right to do this? What can I do next? I'd like to say it is just the principle of the thing, but at the moment I can't spare 12p, let alone £12.00....

forward the email back to them and tell them to point out where the credit agreement is in that paper work.

then tell them that failure to provide you with the proof you had received it will result in cancelling the policy and taking your business else where.

honestly, MCE are more trouble than they're worth. isnt hard considering they're worth fuck all really.

im with bikesure insurance. underwriter is adrian flux and have a credit agreement with premium credit services. not had any issues with them. everything got sent in email and post as per requested.

if premium credit services send you a letter they also invite you to create an online account with them where you can electronically sign your agreement and the letters they post out are also uploaded to your account in PDF format.

as far as credit service companies premium credit seem pretty decent. and as i said, not had any issues with adrian flux or bike insure.

Oh, MCE, they're so wacky.

You may want to PM "arry" and ask for advice.

What I'd do personally? Email them and say "I require you to handle this as a complaint"

Point out that since they chose not to enumerate the documents that you were supposed to have received, you could not you have made an informed confirmation that you'd got the missing one.

Instruct them that you do not give authority to collect one penny beyond the agreed premium.

At any sign that they're going to keep arguing, simply cancel the direct debit and tell them that due to their failure to supply all the documentation in a timely fashion, the contract is void.

If they want to knock it up a notch, ask them how long it will take to exhaust their complaints procedure before you can take it to the Financial Ombudsman Service.

Have fun with it. At the moment you're insured, you presumably haven't paid them anything, and they can't really do much to get any money out of you except bluster. At most, offer to pay pro rata for the days that you used, but not any setup, admin or cancellation fee, since they screwed that up. That makes you the reasonable one should it even reach County Court (and it won't, it's not worth anyone's time).
