Just wondering if anyone knows about self employed people who work for companies (Sub contractors) rights & What not

Basically I was a supervisor for a tiling company but my boss was always saying i should get on the tools as well which I did Gladly While supervising these 2 god awful tilers, My boss came into work one friday moaning about the quality of their work blaming me for it, I said to him if i'm off doing other stuff I can't hold their hand, he was saying its my responsibility (Which it is unless i'm being told I should be off in a different building doing other jobs)
They were using rapid adhesive and tiling on to backing board so within an hour theres nothing that can be done to fix mistakes other than ripping everything off and starting again, The problem being that the company didn't order enough tiles and couldn't get any more!!

(this is where I summarise)

We had a big of an argument that evening but it seemed to end amicably, went back in on monday made the tilers replace some of the shit work (turns out there was 2 more boxes in the office) I thought everything must have been ok between me and the company otherwise why have me in on the monday?

Tuesday morning at 6am I get a text saying don't go in because 'they have a meeting with the contractor'
so even though I knew what was going on i text him the next day to ask if i should go in and he fed me a load of drivvel about the meeting not going well and they were just going to finnish up and that was it.

A week later I was due 2 weeks money (10 shifts) I was only paid for 8, I've been texting and calling but to no replies until today 1 of the bosses called me and said "we can't pay you because we've been told you were standing around doing nothing all the time and playing games on your phone"
I then spent the next 25 minutes telling him exactly what I was doing and that it probably looked like I was doing nothing because I had to watch everything they did otherwise all the work would be shit! if I was on my phone it was because I was talking to 1 of the bosses because they never had any materials on site!

(just to mention, these tilers were so bad 1 of them actually tilled themselves into a corner and there was 1 bathroom where they put every single trim on wonky....lol)

The site manager that told him I was standing around doing nothing was a complete liar anyway and had seemed determined to fuck me over for weeks, There was 1 time when I was on my knees washing grout off the floor and he told my boss that everyone was standing around doing nothing, when I called him out on it he changed his tune he did that at least 3 tiles while i was in ear shot (Prick!)

So now they owe me 3 shifts and it seems aren't planning on paying me,
I have paperwork signed by the site manager that I was at work stating what we did on what days.

Would this be enough to win a case against them? was going to use moneyclaim.gov.uk

Any help would be greatly appreciated Smile

Do a Google on subbies not being paid & try to absorb the gist of the info from respected sources.

This type of scenario should come up often on legal advice sites.

It's happened to me in the past, fortunately I'm big & ugly enough to usually have MY money thrust at me not long after casually strolling into the office.

You have to follow a proceedure, you have to request your money, they either pay you or give you the reason why not. Sounds simple, but if you just slap a case into moneyclaim online it'll get thrown out & end up costing you.

Good luck.

I had a google but completly unrelated stuff kept coming up Mad

I was going to send them a written request via email and give them 14 days as it says on moneyclaim, There reasons imo are unfounded and are just through word of mouth so i wondered how much this would hold up in case of a claim, considering I have signatures of the site managers saying we did what we was there to do.

there has been a slight update, I am due to get paid for 1 shift tomorrow and it seems they are going to pay me for it (well they've emailed me a payslip), still can't handle them stealing 2 shifts off of me though!

Cheers for the reply.

The Co op (that well known ethical company) fuck their subbies over regularly, especially drivers delivering their washing machines and fridges.

A mate of mine was given the wrong washer at the warehouse, (everything checked and right on his paperwork, but not what the customer ordered).
Delivered it and customer noticed it wasn't correct machine after it was unpacked.
(Cunt of a warehouse manager told my mate he should have checked customers invoices before he unpacked it.)

Took it back to warehouse unpacked, they charged my mate the full retail cost of machine, £350 plus £45 "handling charge", to cover a Co op office fuck up.

They have the time, the money, and the legal team to fuck subbies over big time.

Co op, bunch of cunts.
