Accident claim question

Hi,

Still trying to sort out the claim for my accident last year, it's going nowhere fast atm. I sent my solicitors a snotty email last night saying that because I still haven't been paid for my current out of pocket expenses (now over £350) that I won't be going to any appointments they make for me until I have.

My question is am I going to get a load of grief about doing this? I made them aware that I've been bounced around Suffolk,for a year now, and am finally at the end of my tether :/

Is it a damage only claim or is there personal injury involved?

It is usual for your out of pocket expenses (called special damages) to be paid with your compensation at the successful conclusion of the case. The only payments that are usually paid before liability is admitted is if an interim payment is requested and paid during the ongoing process (which usually applies to the more serious cases), and in some cases the cost of replacing the bike and this is usually dependent on liability being admitted.

But that is no excuse for your currently pushing you around the place, they should have no problem advising you of how any payments are scheduled.

Hiya,

There will be personal injury with this one, I'm still suffering with a shoulder weakness and some minor back pain.

I've had 2 interim payments 1 for the bike and 1 for the gear (and I had to fight tooth and nail for them to get them requested and at the right amounts) and they came months after liability was admitted by the other side.

I also (after checking 3 times with them) paid out of my own pocket to hire a bike after the hire company took theirs back after 85 days, now they're telling me that wasn't acceptable =/ but are claiming loss of use for me.

In my email I instructed them to call me at some point before 10am as I work nights and would be in bed after then, at 9.59 the phone goes off, talk about cutting it fine! It seems tht this has given them a little bit of a kick up the arse to get it sorted out.
