Got pulled doing 90 in a 60 (in a car not on my bike) Do i need a solicitor when im summoned to court? and any other decent advice anyone has on the whole situation would be very much apreciated because at the moment im F****D haha

Well, you don't have to have one, no.

If it's magistrates court, then it is fairly straight forward. They have you bang to rights basically so be humble and remorseful and don't try to justify it - you broke the law, they caught you - respect the system and hopefully they'll go easy on you.

Oh yeah and turn up EARLY and look smart. And be prepared to say something.

There is a fair chance you will get a ban as you were doing 50% over the speed limit. I Don't think it would hurt to get some legal advice

it may be an idea to join the IAM fast & get lessons for the car . if you manage to pass your advanced test before court .... u never know the judge may not be so harsh on you , also if you have a solicitor to say you've changed your ways ...

you may be offered a speed awareness course if this was your first offence, for secound offenders they really throw the book at you - sorry this is coming from me, police took my bike off me wrongly, and now i'm getting around 8 points, ive taken it to court and currently fighting them for justice.

I was under the understanding that you are only offered the speed awareness course if it's (something like 10%) above the limit. Anything higher and they do you anyway.

90 in a 60 is enough for an instant ban even if you're currently clean.

If you're offered a FPN, you should probably bite their hand off. If you get a summons, I'd suggest that you pay for a specialist motoring solicitor to try and find some holes in the case. They get to be bolshy on your behalf, and if the CPS don't fold before you're inside the courtroom, they can plead exceptional hardship while you blub and sniffle.

Magistrates guidelines say,

4 - 6 points

Fine depending on income, probably around £250

Ban possible, 7 to 28 days.

(That would be a ban OR points, not both)

I got pulled about a month ago for doing 98.3mph on the motorway.
The offer was FPN or Court.
I took the 3 points and £60 fine.
I had no excuse other than stupidity for being caught as I knew the places they lurk.

How were you nicked? "Safety" van? follow check? Gatso?
Were there any kitten frightening aggravating factors? Any hint from plod about due care or dangerous driving?

Same, i got offered this when i was caught by a gatso doing 34 in a 30 zone.

Also i cant do another for 2 years.

Some more info would be helpful from the OP, were you caught by a camera or pulled by plod? usually if they see you (say they are sitting on a bridge or at the side of the road without a camera) they have to stop you straight away from what i'm told? (could be wrong though!)

I got caught at 92 in a 60 in my van, car followed me for 1.5 miles in the dark.


Went to court, dressed well, begged a bit and got 4 points and £400 fine.

Thumbs Up

As far as I'm aware, they have 6 months to issue the summons. Mine dropped through the door 5 months and 3 weeks after the offence Laughing

Yep, the have 6months from the date of offence to issue a summons. However, that is if they know the driver (I.e. they stop you), if not it's 28days for a s172 where you have to state who was driving.

No aggrivating stuff like due care etc, and i was caught at 22:30 hours in the dark by two traffic officers in a bmw with a radar gun. Would the fact that i intend to join the ambulance service and need my license and i have been volunteering for ages to achieve this career goal help me?

I would suggest that you speak to a local solicitor who knows what sob stories the local magistrates tend to swallow.

Hahahaha they did the same to me when i lost my driving licence (got it back) was about the3 same time difference, im sure they know what their doing :/

Not worth doing anything till the summons comes through, then check the paper work and get yourself a free 20mins with a local lawyer.

Were the coppers just having a slow day and intent on reporting you for the offence or where you a bit arsey?
Given the time of day and no previous points they could have been nice and given you a penalty notice there and then. C**TS. Thumbs Up

Mine was 23.45hr an I was as nice as humble pie could be, used terms like over enthusiastic, making too much progress, The evidence speaks for it's self, said sorry and did all the I'm stupid bit. Thanked him for offering the points option.

Six months from the date of the offence to lay the information before the court. Therefore summons could arrive a month after that.
