OK,

let me begin by saying im not rude... I just do not like to be inconvenienced...

If im asked POLITELY to remove my helmet, I would have no issues doing so...

but:

I went into tesco, Stratford upon Avon yesterday night,

Walked past the security guard on the way in. He said hi, and smiled at me...

I had my helmet on. (no signs saying remove etc, I only needed a bottle of milk, and was going to use self checkout since it was 1 am.)

so, i go to milk, grab it, get to self checkout, bank card in hand about to put it into the chip n pin and hear "Oi pal, you gotta take that off" in such an obnoxious manner.

I was like .... ok he isnt speaking to ME like THAT is he????....

he then went "oi, didnt you hear me, Take that helmet off NOW!"

to which i was like .... wtf is this guys problem???? who the hell does he think HE is speaking to????.... "erm, NO!"
(i will not be spoken to 1) like a child, 2) like a P.o.S.)

"Well either take it off, or your not having the milk~"

mee: "tell you what pal" (pick milk up and chuck it at him) "have your bloody milk, ya twat"


I then went to the customer service desk and asked to speak to the duty manager (I actually took off my glasses and popped my helmet up now so as i could speak to the manager.... Like i said, Im not rude, if i am going to be talking to somebody I will remove my helmet)


The guy didnt seam to give a crap how the guard spoke to me...

I asked WHY i needed to remove my helmet, and why, when i passed the guy as i came in nothing was said, and it wasnt until the woman on the other side of the store said to him that i had my helmet on and it needed taking off, something was said.

his response "Its a security issue"
my response "how about the health and safety issue with spills on the floor not being mopped up... for instance this one right here!" (luckily a perfect example less that 100yds away from me) "or card board boxes being strewn across the floor where somebody could step onto it and go flying... or the fact that nearly EVERY aisle down there has a trolly blocking it so that you cant walk down it, never mind get a shopping trolly down it."

he didnt want to even comment on any of those things...

infact i found his mannerism as bad as the way that the security guard had spoken to me...

then to top it all off... as i was leaving the store, the bloody automatic doors shut on me, actually bruising my arm... (they opened half way, as i walked through them, they juddered and shut on me...)

i called and spoke with the deputy manager today, he basically laughed at me when i said about this...

long story short...

I feel appalled that tesco treat loyal customers like this... im just wondering if anybody else has had the same response?

and if when being asked to remove your helmet you have been spoken to politely or in a manner only a jumped up little.... well power high wanna be could use.

needless to say, ive lodged a formal complaint (not because i was told to remove my helmet, but the way it was done)

ive also put in a sar request for CCTV footage, which will show doors closing on me... OTW out (£10 fee payable but not happy that if i was carrying my helmet, and it wasnt my head, that would of meant i would need to buy a new helmet - bang to helmet = new one needed)

i fired off a letter of complaint via email pretty much immediately... mainly because I was more p''''ed with the way the duty manager spoke to me, never mind the security guard...




i fired off the following email to customer service, and the CEO phillip clarke

Now, let me state this: My helmet is not cheap. It is an expensive piece of safety wear. If it gets a knock, its safety properties could be compromised. which means that my helmet would need to be replaced. Even a slight knock could get mean that I need to replace my helmet...



Considering your staff who push the trollies around the store barely look where they are going and expect the customer to move for them (which surely should be "this trolly could hurt somebody... *I* (the member of staff) should be carefull")... it is quite a high possibility that my helmet could get bashed in your store...



Also, It is not actually your right under the law to instruct me to remove my helmet. If you do not want to me wear my helmet in the store, stick some signs up outside so bikers know that they cannot wear their helmet in the store.



Now let me state some issues which should be taken more seriously...



firstly, your security guard...



it is the law that all security guards have an SIA license. and it is a criminal offence not to display such a license whilst on duty. More information can be found here:

I understand that some companies can be granted an excemption, but considering that Sainsbury's and Asda have not been granted such an excemption, and neither has the Tesco in Warwick, i find it hard to believe that Tesco SUA have been granted such an excemption.

Secondly,



Health and safety...



Your store aisles are always blocked with trollies, which is results in people being unable to pass the aisles.



Your floors are always strewn with cardboard, which is a slip hazard.



Spills are never cleared up... (as was the case this evening)



The duty manager didnt appear to be bothered to resolve any of those issues.



Now, lets get back to the "Security Issue"...


Would you insist that a muslim woman removed her Burka?



I find it very insulting that I am instructed to remove my helmet when im at a self serve checkout paying for a single bottle of milk.



Doing so means i have to remove my glasses, I then have to remove my gloves so as to unclip my helmet release catch. I then have to put my helmet back on when I have finished. - which being a glasses wearer is not convenient.



I have never been instructed to remove my helmet at any Asda Store, nor sainsbury's, and to be quite frank, I feel greatly disappointed in the entire service that I recieve from Tesco's in general.



You can check my Clubcard Account to see how much of a regular customer I am with Tesco. Despite the fact that I get a 5% discount at both Asda and Sainsbury's since I work for McDonalds, I still use Tesco as my main shopping store. I do however, after such appalling treatment this evening intend to switch my Store.



I work in Leamington Spa, so it is simple for me to nip through to Asda to do my shopping.



I have just looked at the tesco website. There is nothing within the company policies that states a helmet must be removed. This is the point where I now refuse to use your store on the grounds of discrimination against bikers. I feel it is discrimination against myself, and until I see that you start making other people remove headwear including religious headwear then you have now lost out on my money.



I asked why it is the case that Muslim women are not instructed to remove their burkas, and I failed to recieve a reply...



Could you clarify your stance on headwear in your stores. And explain to me, why Despite the Religious Equality laws, it is a case that EQUALITY is not being observed, when a woman in a burka doesnt need to remove her headwear, yet a BIKER in a Crash Helmet (where the safest place for it is on his/her head) is instructed to remove it.

but, as i wasnt happy with the response, i also called the store today, because the cardboard / trolly problem isnt the first time ive complained about this... and i received a letter from the manager assuring me this would be dealt with previously (after my daughter slipped on it a previous time)

i was also not happy after seeing the massive bruise on my arm from the doors closing on me...

I spoke to the manager, and he wasnt any help. I told him at this point, that i wished to recieve a copy of the cctv. he said i didnt have the right to it... so i stated that under the DPA 1998 i could request a copy of any CCTV where either myself or my vehicle is part of the footage as it is considered under the DPA as "Data relating to me"... he said that i didnt have the right, yet again, so i asked him for the tel no to main customer services his response was "look online for it" to which i found a great annoyance, so went "no, how about you follow your own complaint proceedure, and find me the telephone number!" to which he trundled off, and i got the no off him"...

i called the no, spoke with a nice lady. she confirmed a helmet cannot be worn. i confirmed that the issue wasnt with me having to remove it, but the way i was instructed to do so. I dont appriciate being spoken to in such a manner...

i explained all of my complaints... (cardboard, blocked aisles, spillages on the floor uncleared, lack of SIA on contracted external security guard)

she then said "i cannot deal with this because im not versed in all of the laws"
so i asked to speak to her manager ... again a nice fellow... i went to explain again (usually have to if you complain) but he stopped me, the lady had quickly filled him in and he could see detailed notes on the screen.

he said he would speak to management about putting signage on the store windows to advertise no helmet policy (which is good)...
cannot comment on religious headwear etc... would look into SIA badge, but then here came the fun:

"can you go back to the store to complete an accident report, so as we can conduct an investigation"

so went back to the store after work tonight., and OMG. the manners of these people...

I was in my car (as on weekends i drive collegues home due to late close). the security guard tried to argue with me, the manager was useless... and the security guard even tried to pick a fight with me (at least im 99% certain of it) but didnt have the balls to repeat himself when i walked back up to him.

so off went another email complaint...

this time with my SAR. (ive included a request for a full copy of my purchases so they can see how much money they are going to loose from my custom...

I spend over £60 a week in fuel for car, £100 week in shopping (nappies, food, etc) plus have credit card...

i intend to boycott tesco myself over this, from now on, and am actually considering legal action due to injuries... (i know its only a bruise, but its the principle of the fact)

RE: Subject Access Report / CCTV Footage / Further to my Complaint

Further to my visit this evening, I would like to raise yet a further complaint.

First of all, when I called up the Customer Services team today, I was requested to visit the store to make an accident report forinvestigation, as the store doors had closed on myself, resulting in bruising to the top of my arm on my right arm.

I spoke with the duty manager, and he refused to complete the accident book, as he "is not allowed to record an accident without witnesses". Now, I went into the store this evening to complete the accident book on the request of one of the managers in your customer service department. I would also like to point out that ALL allegations of injuries should also be noted in the accident book, and it is for the accident to be investigated to reduce accidents, and minimise risk. Completing an accident book by no means accepts liability for an accident. Even though I explained this to the duty manager this evening, he still refused to complete the accident book.

Now, I know the following is actually law: All companies with ten or more employees are required by law to have a work accident book. The work accident book must be used to record details of all accidents that take place on the employer’s premises. The book is used to record details of all accidents in the work place – from minor to major – which result in injuries. This includes accidents such as slips and trips, cut fingers, injuries caused by faulty office equipment and fork-lift truck accidents, to both employees and customers.

Details of the accident can be entered into the work accident book either by the injured party or by a colleague. All information in the work accident book must be kept confidential and it is for this reason that most work accident books are now made up of pull out/removable pages. Details of the date, name of the injured party, witnesses, full circumstances of the accident and resulting injuries must be entered into the accident book. Information in the work accident book is legally required to be stored safely for three years.

Even after showing the duty manager the bruising to my arm, (which can be seen on CCTV) he still refused to complete the book. Instead, he simply took my name, address and telephone number.


For this reason, I would request a copy of all CCTV images you hold of myself. Under the Data Protection Act 1998 I have the right to access images of yourself that may have been recorded by a CCTV camera system. This is because the Data Protection Act of 1998 means that organisations have to make any personal data available to you if you request it. This is known as a subject Access Report.

I am now filing a Subject Access Report with Tesco's for ALL information you hold about myself. Including the CCTV footage of myself at approximately 00:01 on the 10th August 2012. In addition to the CCTV footage from approximately 1:35AM onwards on the 11th August 2012. Whilst making this request, I also request a copy of all of the footage you can submit to myself from my vehicles on your property. My vehicle registration marks are xxxxxx a Silver Vauxhall Meriva (the vehicle I arrived to the store in on the 11th of August) and A Red Lexmoto Motorcycle with the Registration Mark xxxxx (the vehicle I arrived on to the store on 10th August 2012). Considering the vehicles are both owned and registered to myself, anything pertaining to them are considered, for the purposes of the DPA 1998 to be Data in Regards to myself.

The organisation must give me a copy of the CCTV footage within 40 days of you asking for it. I understand that I may be charged a fee of up to a maximum of £10 to help cover your costs in completing this SAR request.

Also, whilst on the SAR request that I am filing, I am not limiting the scope of the report to the CCTV footage.

Under the data protection act I am requesting a copy of all information you hold about myself, to be provided to myself. This includes all call recordings, call transcripts, account notes, buying patterns, trending research, purchase history ETC...

Please supply the information about me - I am entitled to make such a request under the Data Protection Act 1998 - relating to myself and my account(s).

Please would you also tell me the logic involved in any automated decisions you have made about me.

If you need any more information from me, so as to allow you to perform this subject access report, please let me know as soon as possible. Also, if you do not normally deal with these requests, please pass this letter to your Data Controller or another appropriate officer within your organisation.

I am sure that I do not need to remind you that the act covers both facts and opinions about myself as an individual, as well as information regarding the intentions of your organisation towards myself. The request should therefore cover any internal/external memos, emails, faxes and any other correspondence or readily accessible data held on computer by your organisation which could be classified as 'personal data', in addition to any available boxed paper files.

Also with the subject access report, i would also like the following: a copy of the information in permanent form; an explanation of any technical or complicated terms; any information the organisation has about where they got my information from; a description of the information, the purposes for processing the information and who the organisation is sharing the information with; and the logic involved in any automated decisions.

So as to aid you in finding the information requested here is a little bit of information to aid you. This information can also be used to verify my identification, as you have an ongoing business relationship with myself, at my current address.

My Tesco Clubcard Credit card account number is: xxxxxxxxxxxxxxxxx

Both of these accounts are held in my address as detailed above, and said address has always been your prefered method to communicate my personal business.

If alternative funding is required then I urge you to get in touch with myself as soon as possibleas I will expect you to confirm such, as with any further information. I will expect a complete report to be on my doormat by 19th September 2012 (being 40 days from the date of reciept by yourselves - and this is being sent via Email so is being recieved on 11th August 2012.

I am a male of about 5 foot 11 inches in height. When I arrived at your store on 10th August, I arrived at approximately midnight, on a Red Lexmoto motorcycle with the registration mark xxxxxxx. I was wearing a Silver/Grey helmet, Black coat with blue detailing, black jeans, and black boots with silver and blue detailing. I was also wearing glasses. I parked by motorcycle next to a white Honda CB1000R near to the the Cash machines on the right of the lobby (this should aid you in finding my arrival, as you simply need to find my motorcycle parked between the trolly bay and cash machines.

When I arrived at your store on 11th August, I arrived at approximately 01:35 am, in a silver Vauxhall Meriva with the registration mark xxxxxxx. I was wearing a grey T-Shirt, Black jeans and black shoes. I was still approximately 5' 11". I am of very large build, and was wearing glasses.
I parked my car next to the trolly bay in the behind the store by the parent and child bays. Coincidently, a large number of staff members appear to be parking their vehicles in said parent and child bays... Does this not contradict Tesco policy of Parent and Child bays being reserved for parking cars for the use of PARENT'S WITH THEIR CHILDREN.

Considering that you hold information about dates and times of my purchases on my clubcard account, It would also conclude that you can pinpoint all of the visits I have infact made to your store. I would also request, using this information you have on my Clubcard Account to recieve a copy of all available CCTV footage you hold of myself, and my children. Limiting the footage to that within the Stratford upon Avon store on the Birmingham Road.



I also noticed that the security guard on duty this evening, (the same as yesterday evening) was wearing an Identification Card from Total Security Services, yet STILL did not display an SIA license.

I asked him again where is license was, and he stated that it is not my right to see his license, and that he only has to produce it to an inspector on an inspection.

Now, the information on the SIA website contridicts his information...

Front line staff must:
•Wear the licence where it can be seen at all times when engaging in designated licensable activity unless you have reported it lost or stolen, or it is in our possession.*
•Tell us and the police in writing as soon as practicable if your licence is lost or stolen.
•Tell us in writing as soon as practicable of any convictions, cautions or warnings, or charges for relevant offences whether committed in the UK or abroad.
•Tell us in writing of any changes to your name or address as soon as practicable.
•Not deface or change the licence in any way (should your licence become damaged, you should advise us and request a replacement).
•Not wear a licence that has been defaced or altered in any way.
•Produce the licence for inspection on the request of any constable, any member or employee of the SIA or other person authorised by the SIA.
•Return the licence to us as soon as practicable if you are asked to do so.
•Tell us in writing as soon as practicable of any change to your right to remain or work in the UK.


Now my complaint about this man, is he is a very rude individual. Although I understand that he is not directly employed by Tesco's, he is still a representative of your company, and should therefore behave in a manner suited to your organisation.

When I was leaving your store this evening the security guard followed me out, and immediately light a cigarette right next to the doors. I pointed out to him, that under current UK legislation he should move AWAY from the door, and could not smoke in the doorway. He then began to argue with myself that I did not know the law, and that he comes from Africa and can still teach me the law.

As I approached my car this evening, the security guard also had the audacity to say something along the lines of "Its a shame you wasn't outside last night when I came out" to which I turned round, and told him to repeat what he just said, with the line "What did you say? Say what you just said about going outside again, if you've got the balls to". At this point the duty manager approached to calm the situation. However, again, the manner in which this security guard spoke to me YET AGAIN I find disgusting. I feel that the man was actually THREATENING ME with voilence when he used those words. However, he didn't dare repeat the same statement again once I approached him and challenged him to repeat himself.


Now, I would like to point out the following:

What are the penalties for not complying with the law in relation to the smoking ban?
There are 3 offences:
- Failing to prevent smoking for which there is a fine up to £2500
- Smoking in a smoke free place – fine of up to £200 or a fixed penalty notice of £50 (discounted to £30 for early payment)
- Failing to display the no smoking signs - fine up to £1000 or fixed penalty notice of £200 (discounted to £150 for early payment)


I find it disgusting that members of staff smoke next to the trolly park. Members of the public have to walk through a cloud of cigarette smoke to get to their cars. Even more so considering the parent and child bays are actually located around the corner to this trolly park. So children also have no choice but to walk through the said cloud of smoke.

I would expect a response to this email as soon as possible.

The security guard is probably sick to death of being polite to people at 1am who are instantly rude back.

So he goes on the offence straight away as it may get the better result based on his experience.

Best option would be to hurt their custom as much as possible! Stick a road/store closed sign (or a couple cones if you can't find a sign) on the entrance road at a time just before the store is at its busiest, that'll cost 'em Thumbs Up

Sounds like you could win this and get a free Pint of milk. Yay! Go you. Seriously though, the lid thing is a non issue. Fair enough he talked to you like a twat. I'd have taken it off and have a word with him along the lines of:

"you know you'd get a much better response if you talked to people properly" then I'd mention it to the manager and leave it at that. Graveyard shift at tesco must suck though. You can't expect security who choose unsociable hours to have an social skills.

Don't write 'discrimination against bikers'. Its incorrect and moronic. You need to change it to 'discrimination against motorcyclists'.

I didn't read the rest of your letter as I thought it was over the top.

He shouldn't have spoken to you in that way, but I think you took it too far.

Chill out dude. Life is full of people who are arses. But then there are also there is also the sound dudes.

I've been parking in the same place every day for 4 years with nothing said. Then suddenly a security guard decides that bikes can't park there any more "incase kids touch it". I argued my case slightly but then moved.

The day before, one of the other security guards (a total legend) gave me a tip off that the traffic cops were staking out my ZX9 because they saw me leave work "quickly" the night before. (this might actually be related to why bikes can't park there anymore).

Don't take life too seriously. There are power hungry assholes everywhere. Know when it's time to fight and when it's not. Also, sometimes you need to feign submissiveness and respect. This is done to trick the person to think that they are the ones in power when in reality you are the one that is in control as you are manipulating the outcome.

There are battles that are worth fighting, and don't get me wrong, a lot of things in life do frustrate me, but save your energy for when it's needed.

He shouldn't, but in the end the security guard got what he wanted (OP was unable to make a purchase without removing helmet as per the store policy) and the OP ended up milkless and so totally totally butthurt that he wrote an encyclopedic essay to someone who doesn't give a flying shit.

Can't blame security for going for the attitude which gets the required result first time. I hope his managers understand the amount of "try it on" dickweeds he has to deal with at 1am and back him if anyone ever reads that drivel up there and acts on it.

Just like it is manners to remove your hat in many social situations, it is also considered manners to remove your helmet when entering someone else's property.

The security guard may have been rude to you, but you were rude to him first.

I have gone in as a "normal" person, done a full large shop, had it put through the till and just as I'm being asked to pay stopped and said, " Oh I forgot you don't serve bikers, I'm a biker, I'm one of those that you don't want to come in the store wearing their safety equipment" and have then just left the store.

I have made sure it wasn't one of my local stores that I would use again, just in case they try to bar me.

I have also in the past just put my shopping basket full of shopping on the floor and just walked out when asked to remove my lid.

In general I do remove my lid when going in to a shops though.

Good grief, you obviously dont read the signs that ask you to remove motorcycle helmets at the entrance then?

IIRC you probably don't have access to it. I believe it needs to be organised in a manner that relates to you as an individual. So, name, address, etc. You can't claim access I believe to any random CCTV that just happens to have you on it.

This argument is flawed though, because if you were a robber you wouldn't take the lid off before coming in anyway, you'd just go in all guns blazing with the lid on, so what's the difference?

I see why the OP got pissed off but at 1am, over a pint of milk id just take it off and comply. You just know he's had a load of pissed people in there already by that point and probably lost all patience.
