My ex won't return some of my belongings, she returned everything except the stuff I actually need.

The stuff comes to the value of £1000, that will cost £70 in court fees which she will have to pay if my claim is successful.

I only have receipts for around £600 of it. My question is, what if she denies she has any of it, which she is clearly going to do.

How does the small claims court work in a situation like this?

Steal her belongings to the value of your stuff.

Remove car tyres.

Remove cat from exhaust.

Remove bulbs from headlights.

Remove wiper blades (just the rubber bits)

Remind her you want your stuff back.

Still doesn't return it, remove brake pads.

First of all, this.

Secondly, get some kind of other evidence that it is yours. Prove she doesn't need or use it, witnesses to it being yours (seeing you buy it or whatever).

Let me know how this goes because I may have to take someone to a small claims court in a few weeks.

Not always too good.
I would seek advice of a CAB solicitor before you go that route. You might think it's cut and dried...but they might be able to give you that little bit of advice that cuts the mustard.

They will basically be able to give you an idea of the potential outcomes...that way you will be able to see if it's really worth the hassle. You might decide that it's best to write it off and move on with your life and forget it... Karma

Aw things like this are always sh1te.

You can get costs waived at court depending on your income. It's based on your income amount not whether or not you are on benefits too so if you're earnings are below the threshold it's worth doing. I know it's a small-ish amount but it'll just take some of the insult out of the injury.

If the amount is above (i believe) 100quid then it's worth doing. I could be wrong on that amount tho.

Before you start tho, be aware that the person in question is in this for the game not the resolution. They are only interested in fooking you about otherwise why keep a load of stuff they don't need that belongs to you - basically giving you free storage.

In my case it was my bike (police sorted it due to the V5 being in my name etc) cash and some sentimental stuff that can never be replaced. The sentimental stuff - upsetting tho it is - is a write off. The person who gave some of it to me is now deceased. I obviously have no receipts etc for it and it has almost no monetary value.

The cash was difficult but not impossible, luckily the person involved was a complete 'tard and had texted me gloating about not returning it. After lots of back and forth letters via a solicitor to establish facts from sh1te, at the point i was about to take it to the court based on the texts i suddenly got all but 70quid of the cash returned in a cheque (which had a shitty note written on the cheque itself - i sh1t you not)

I was 70 quid down because of the amount it's worth going to court over. The person in question had a lot of entertainment value from being a total 'tard and screwing me around. Although i got most of the money back so i recommend the court route (or at least the threat of it) for anything you can prove is yours. . . .be prepared for the fact that this is all fun, games and power 'tardery for the other party so they'll be as awkward as possible.

With regard to breaking in to get it, don't be tempted. You will (wrong tho it is) be in the wrong.

I had a V5 for my bike, it was insured in my name, i had all the mot, service stuff etc and even the receipt from when i bought it. The person in question didn't even have a bike licence.

I was not allowed to break into the yard they'd locked it in to get it when i contacted the police to ask. However, the person has a 'colourful' character and the police saved me a lot of hassle by using the 'breech of the peace' thing.

They did not technically come out to enforce collection, merely to oversee it to prevent a breech of the peace which they felt was 'likely' from the person involved.

I don't normally have a high opinion of the police tweeking the law to suit themselves. . . . .but i was genuinely pleased that day.

This has been ongoing for around a year and I went last week to pick up what I thought was all my stuff, She gave me pretty much all the pruck of no real value.

The main thing I wanted back was my PC, she gave me the monitor, keyboard, mouse, mouse mat and everything else except the PC itself...

I won't be breaking in.

I will be contacting CAB on Monday though, didn't think of them, cheers!

I've never had a problem getting my stuff back when relationships are over, it's possible to both be reasonable once you break up. My last ex just asked me to go round when she was at work and pick up my stuff and leave her key on the side.

Guess it depends on the kind of people you go out with and what caused you to break up, but I wouldn't really be wanting to go out with someone who gets unreasonable and vindictive etc, often you can see signs well before you get too invested in the relationship
