Householders have the right to get rid of burglars in their homes, says senior judge

Don't know if you recall the recent case where a homeowner with a (legally held) shotgun potted a couple of burglars in his house?

Well, in an amazing display of common sense, Michael Pert QC has chucked out the burglar's pleas for mitigation (being shot whilst they were breaking into someone's home apparently 'traumatised' them) and sent out a clear message that:

If your home is burgled and you're in there, you have the right to get rid of the burglar
......
If you burgle a house in the country where the householder owns a legally held shotgun, that is the chance you take.
.....
The householder is entitled to use reasonable force to get rid of the burglar.



Whilst the whole 'reasonable force' aspect should be well known, MP QC commented that "occasionally it looks as if the householder is the criminal".

Blimey, I'm shocked and stunned. I expected the pair to get a mild slap on the wrist, and (probably) a holiday to Disneyland to compensate them for the injuries they suffered at the hands of the merciless and evil home owner who hadn't looked after their safety when they broke into his house to steal from him, and even had the absolute audacity to shoot them.

Nice to see for once. By all means, forced entry into your home can be reasonable seen as an act of aggression. Who knows if they are just there to nick stuff or if they are also looking for a bit of rape/beating/murder on the side?

Personally in that situation I don't think I'd have gone an confronted them with the shotgun. Instead get all family into one bedroom, with the shotgun pointed at the door and call the police.

I think a reasonable person would agree that, should the "burglars" be opening the door to bedrooms in a house at night they are planning/willing to do some damage to the occupants of said bedrooms.

Would the outbreak of common sense stretch all the way to shotgun certificate renewal time? The real acid test imho. As the couple concerned have emigrated to Australia sadly we will not get to see the results.

Confirms my view that the higher up the judicial system you go, the more likely you are to find a sensible grown up rather than some Kneejerk Norman or Sally Sob-Story. Not always, but usually.

Mind you, I wonder if M'Lurd would hold the same views about home security were a householder to slot a wannabe SWAT-cop smashing in his back door at the crack of dawn... Thinking
