OK....
What have you got?
You can get up to 12 points on a licence before you get a mandatory 'disqualification to drive', I believe for 12 months.
I believe this applies to provisional licences and full licences held over two years, and your licence is 'suspended'.
After period of disqualification, if you had a full-licence, your licence remains 'suspension' you only have provisional entitlement to drive, but you aren't disqualified any more, and you have to take extended re-test to regain 'qualification' to drive, to lift the 'suspension'.
If you only had provisional entitlement when you were disqualified, I believe you have to take the extended test for disqualified driver as first test, but you have provisional entitlement until you take tests.
Note this is my 'understanding'.
Now, New Drivers Act, two year probation, and the six point limit.
Under new drivers act, collect six points or a mandatory disqualification in your first two years of holding a full licence, then your licence is not 'suspended', it is 'REVOKED'.... they take it off, you rip it up, does not exist any more.
You are still disqualified to drive for whatever period was imposed, but when the disqualification period ends, you don't get your licence back, it no longer exists.
You have to re-apply for a new provisional, and start over from scratch taking tests for any and all groups you previously held, though I believe you only have to do standard tests not extended.
Bit of a but-breaker; any certs you held before your licence was revoked, CBT, Theory/Hazard or Mod 1, against your revoked driver's licence, are revoked with it, so back to the beginning to re-do all.
Now, question of bearing, get 8-points on a provisional, and you are over the 6 permitted by NDA, so its oft asked question, does that mean that soon as you pass a test they take away your licence?
NO.
But get just one more point and your licence will be revoked under NDA.
Points stay 'in force' on your licence for five years from date of CONVICTION, take note that is NOT the same as date of offence, and can be a number of months later.
However, after a period of disqualification, the points are 'discharged' from your licence; so get a 3-month ban, and at the end, licence comes back clean, and possible that you could have earned those points and had them discharged between taking out an insurance policy and having to renew.....
BUT kicker is that you are asked to declare all CONVICTIONS, to an insurer, and thier discretion what period they ask about. I believe some, ask for any claims or convictions in the last five years, then separately if any claims for driving under the influence of drugs or alcohol in the last fifteen years.
So, get revoked, get new provisional, re-take tests, get clean licence back, you STILL have to tell them of any convictions that endorsed your 'old' licence.
Points and the time they are 'live' on your licence is only significant, really, to the matter of mandatory disqualification for multiple offences, by points total. ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!
