 |

TL:DR Got a ticket, can I get out of it on the technicality of it having the wrong address on the chitty.
Longer version: I live in a private estate (get me). Recently the estate managing agents have got a bit pissy over parking and have employed a licensed bandit to extort money out of reasonable people for parking in the road way. Usually it doesn't affect me cos I have an allocated space, but last night a friend of my wifes was in that, so I parked in what I thought was an area outside of the parking restrictions. It transpires it wasn't, and I got a ticket. So I have two questions.
1) The ticket has my reg number, time of the digression make of car etc. However, it says the location was 'Little Hackets' (the road I live in), whereas I was actually parked in 'Billys Copse'. Would this alone be reason enough to wriggle out of paying ?
2) I'm aware that the law has recently changed with regard to parking charges, clamping etc. the sage advice on here has always been to ignore non council 'fines' as there is essentially bugger all they can do abut it outside court. Is this still the case, or has the new legislation given the parking firms increased punitive powers ?
Cheers ravers. ____________________ "I hate to advocate drugs, alcohol, violence or insanity to anyone, but they've always worked for me." Hunter S Thompson

I was under the impression, there's not alot they can do,
How often do you hear about private parking fines going to court?
They can only take you to court over the 'fine' amount and that'll cost them more in court fees etc etc
The fact they have the wrong address, well, I don't know about that I'm afraid, you can try and cling to it and lie and say " i was on my own road " if that's allowed.
Generally speaking you get threats and threats and unless they're sub-contracted by the council, it's a long winded battle for you coming up against threatening letters and potentially baylifs coming to your door.
depends how pushy they are.
but the fact you live in the private estate, i dont know how it works, have you signed or agreed to anything in regards to parking in allocated spaces only? if you have, then you might be in a bit of trouble as you've technically breached your contract with the private state guys.
Sorry I know it's not much help, just my opinion. ____________________ I ride a scoot, so what? >_> |

Ignore.
The change in the law means that the Registered Keeper must now tell the scumbags who was driving.
Then they can ignore.
Or go through the complaints procedure via POPLA which costs the parking scumbags £32.
And once they have found against you (which they will cus they are in the pocket of the BPA) you can then continue to ignore.

Don't pay it. It's a private ticket. You can pretty much always get our of paying a private ticket. This site has more info as I'm too lazy to type about it at the moment:

Or...?
As I understand it, it's simply that the keeper can be pursued if they don't identify the driver.
However, it also says that the penalty can be whatever is shown on the sign, rather than just the loss that they suffered (i.e. minimal).
There are still plenty of obstacles in their way though. For one thing, the people demanding money from you with menaces - on what basis are they doing so? As in, who actually owns the bit of road that you were parked on, and what's the relationship between them and the ghouls?
Don't ask them though, you'll just encourage them. ____________________ Biking is 1/20th as dangerous as horse riding.

Or else they'll get very cross.
Very cross indeed.
Oh yes they will.
And they'll probably start sending out letters.
Some of them using red ink !!
So just you bloomin' well think about that. |
Will they use... CAPITAL LETTERS?

Again, why tell them? There's no penalty for not doing so, it just means that the ghouls can pursue the keeper rather than the driver.
However, as previously opined, the new "Freedoms" Act appears to me to make it substantially harder to wriggle out of being held liable if it ever ends up before a court..
I'd encourage my England-and-Welshlander bredren to read it in full, although it's couched in OCD language, written by and for the benefit of lawyers, not humans. ____________________ Biking is 1/20th as dangerous as horse riding.
