At college a woman teacher reversed into my brand new cbr 125. The bike was parked in the car park and not in the designated motorcycle area which is full. There are around 10 bikes which park the other side of the mobile where the motorbike parking is. The driver narrowly missed my mates bike who just got it back on the road that day and hit mine from behind pushing it into the mobile. Major scratches on the headlight, bent up footpeg and minor scratches on the bar end, front mudguard and fairing above the light were the result of this incident. Everyone i have spoke to said she should pay up in full for this and i share the same view although she doesn't except full responsibility for what she has done because it was parked in the wrong place. The bike was not intruding her path of exit of the car park as well. What do you think about my story. Please give you're views on the subject. The damage will cost around £160.

Was it parked in a proper car parking place? im pretty sure bikes have as much right to a car parking spot as a car..

No it was not in a parking bay. it was by the mobile where people park there bikes sometimes but there is enough room to move your car around etc in that area. at the end of the day she reversed into my bike and should pay up. Am I right?

Sounds like you have got good grounds to claim on her insurance. If you were parked and she hit you it is her fault, no question.

Yeah, I'd say so.
Are there any signs up saying that you must park in designated bays only?
Take some photos and make a note of what happened while it's fresh in your mind.

Cheers guys. I don't want to claim it off of her insurance as it would make things more complicated. As the repairs cost around £160 it doesn't seem that worth while. I'm surprised i kept my cool about it though as most people would have gone mental if there new bike had just been knocked over.

she should pay, even if it wasn't in correct space.

It did'nt just suddenly jump out from no where. Its basically driving without due care and attention, it could have been a child let alone your bike.

Mabye not that serious but you get my point.

You should claim off her insurance, £160 is £160 that would proberly take a couple of weeks 2 earn. The only reason i would'nt is if she was my teacher. Even then i would be very tempted.

No there are not any signs displaying no parking etc. Maybe she doesn't like cbr 125's lol. I have already had a meeting with the principle of the college and sent her a formal letter today complete with a quote for the bill.

Anyway if she refused 2 pay. Id wait till she was reversing it again and stick my foot under the wheel. Sue the bitch for a 1000.

Double check the quote as I am surprised that it is only £160. I wouldn't be surprised if the headlight alone would cost that much to replace.

she collided with a stationary object i.e. your bike....urm her fault me thinks...if it was a wall would the wall be at fault for being in her way..like wise a child?...

Ive had bikes run over by cars on two ocassioons, both occasions I got the cost of repairs covered by the drivers who hit them. Never had any disputes about it though, when caught (one of them just drove off and I spent ages kicking my bike over to catch her up as the fall had emptied the float chamber, all the while seeing her car trundle off in the distance, although she claimed that she thought she had hit a lampost Rolling Eyes ) . The Other one was when my kawasaki got flattened by someone else reversing over it. She came back to my freinds house (where it happened) after work and was very good about it, as was the other person when I spoke to her. At least you know who did it. Hopefully you have witnesses should there be a problem. All you can do at the moment is to write her a letter and include a quote from a bike shop to have the work done, like you are doing (you can later offer her to fix it yourself at a lower cost should you choose) and speek to her about it. Sometimes you may need to find a few quotes as cagers seem to think that bike parts are a lot cheaper than they are, let her sujest a bike shop to get the quote from if she insists your trying to rip her off. Good luck with it, and I hope your bike is fixed back to exactly how it was.

If she's not going to pay up then just go through her insurance.

Get some photos of where you parked the bike, draw some diagrams of how it happened and let the insurance company sort it out.

How was the principal about it? It's a good approach to contact them as long as you do it subtly.

As Milo said, I would take some pictures of the area it was parked in just in case it was needed. If you try to be fairly subtle about this too, but not overly, at least so she sees you doing it. It will show her that you won't be fobbed off and intend to report it to the insurance company if you need to. A bit of gentle leverage won't hurt.

As far as parking goes, I would imagine that if you weren't parked is a silly position giving her no room to manoeuver and it didn't specifically say no/restricted parking then she hasn't got a leg to stand on.

If she doesn't pay up and you choose to go through her insurance, then you might have problems there as you didn't mention anywhere that you called the police - so I assume that you didn't, right?

Insurance companies will get out of claims any way they can; and if she denies the 'incident', and the police were never called, and there weren't any witnesses... who's to say you aren't making the whole thing up, fell off your bike somewhere else and trying to get someone else to pay for the damage by inventing a different scenario?

(Sorry, used to work in insurance - seen it happen) Rolling Eyes

I didn't think you had to call the police unless someone was injured as a result of the accident or someone had not stopped at the scene?

unlucky mate, i would claim off her no questions asked if she's your teacher or not, she knocked your bike over and damaged it so she should pay for it, if you have any problems with her in the future get her fired... Laughing Laughing and i'd take all the advice you've been given leave nothing to chance as dainesefreak said they will get out of it anyway they can...
