wouldnt they have to refund the test fees if they was on strike?

seems somewhat illegitimate to keep the fees when the workers strike is outside of your control!

then again, do they refund the fees when the examiner cancels due to weather or whatever?

Someone else mentioned their DAS Mod 2 being cancelled yesterday so it's likely to be a wide-union based thing. They will refund the feeds I imagine.

If that happened, you couldn't get a test until after the 19th, then you are subject to the new rules. They become law, and can't be changed locally.
