At about 2pm today I was coming home from school on my 125 down a smallish road when all of sudden this dickhead in a 4x4 reverses right into the middle of the road. I was literally about 2 car lengths behind him at this point and I had no idea where he came from, it's my second day out on the bike and so I have very little experience. Out of shock i pulled both brakes but more of the front and this led to the front of the bike locking up and me falling off. He pulled over to the side of the road and saw me trying to pick the bike up from the middle of the road whilst he was walking down the road in his twat suit whilst grinning. I was partly blacking out due to my head hitting the floor. It turned out he was going to an awards evening thing at my school so I called my dad and we waited for him to come out. It turned out that he hadn't even seen me which I guess is fair enough, but what pissed me off was the fact that he showed no sympathy at the time of the accident nor when we confronted him later. There was only really cosmetic damage to the bike, both indicators snapped and scratches to the fairings, also my helmet is fucked. nice gash on my leg too and I sprained my elbow.
Would the police/insurance see this in my favor? Also could I report him for failing to issue details at the scene of a crash?

You know, I'm usually on the receiving end of alot of crap, so it's not often I'll dish it out without reason, but that really wanted me to make a remark about the poor lad.
I'll give him the benefit of the doubt personally as I'm not involved in anyones disputes. But I couldnt help but snigger about it being along the lines of "Well I know people who can help give him tips and practice". I'm not going there though.
Ollie, back to the original question, yeah, don't bother with insurance.
Also, you may find you need to try and fit in more with people.
There aren't many uk bike forums where people are as helpful as some of them around here.
If i can make the effort, I'm sure you can too.

You fell off. how much of your falling off was your lack of experience and basic machine control? How much panic? How much the short distance warning you had?
You should have been traveling at a speed at which you could safely stop in the distance you could see to be clear.
You should have been observing for 'hazards' OFF the road as well as on it. Which means, looking for people getting into or out of parked cars, the 'tell' of a car being started by the smoke coming out of an exhaust, of any other 'clue' you might have some-one might do something to bring you down. Pedestrians pushing a pram out infront of them; cyclist leaping off the pavement. Dog running out from a garden. Football kicked over a park fence.
Just becouse you are between the kerb-stones doesn't mean thats the only place you'll find hazards coming at you.
You should NOT rely on other people doing what they ought to, and most CERTAINLY not expect them to be looking out for you.
Car drivers look for other cars; they see 'car' or they see 'No-Car'. Bike is 'No Car' which they interpret to mean 'Space'.... that's why they pull out, not because they don't see you, but because they have seen 'No-Car'.
Those are the lessons to be learned..... here's the sympathy.
Dust yourself down. Calm down. Count your bruises. Count your blessings that they are ONLY bruises; and chalk it up as rapid experience building!

You didn't hit him, which suggests that you could have stopped in the distance you crashed in.... bikes with tyres in contact with road, and brakes applied tend to slow and steer better than ones with random bits of metal grating down tarmac..... had you maintained control.
He was NOT involved in a 'collission', so nope; I dont see that he has broken any laws not stopping or swapping insurance details, or that he is to 'blame' for you 'falling off', as far as insurance claims go.

Just to add to Tef's post.
This is possibly the worst time for new bikers.
Cold, snow, ice, high winds, rain, getting dark earlier, poorly set cage lights and of course, arrogant, ignorant, flustered cagers hurtling everywhere not giving a dead rotting rotends backside about anyone else because not only do they live in their own little box but they are "busy" doing last minute christmas shopping as well.
In all honesty, i have a few months experience now and I'm still not keen on being out on the bike after dark at this time of year. Your on a 125 which means your headlamp is probably crappy as well so you really do need to get practice in quiet areas even if its learning to spot those darned pot holes and man hole covers and avoiding them in the dark.
being able to do that will help dramatically in avoiding hazards.
Ask a friend to come out to a quiet area and practice your emergency stop, have them raise their hand at random times to help and signal you when to stop.
That will help you not lock up your wheels when you need to brake harsh.
I did something similar but used my mp3 player and listened for "triggers" in the songs. i.e certain phrases or words that would come up at random and when i heard them started the e-stop.
Now i can safely perform an e-stop without worrying about locking up and falling off.

Thanks for that , I do normally look for padestrians and vehicle that may be a hazard. However it was concealed behind a wall so I had no idea it was even there.
