how many on here have had issues with DVLA and them claiming not to have received the v5 when selling a bike / car

I know theres a few paddy is in court just now and I just paid a £75 because of this to avoid hassle

twice this has happened to me, both involving the police

first time I sold a car back in the late 90's sent off the form's etc and forgot about it
15 months later I had the CID at my door asking about said car and where was I on such and such a night
I told them I didn't own the car and hadn't for over a year, turns out it was used in a smash & grab robbery in Newcastle Rolling Eyes
but DVLA had me as the last known keeper even though it turns out it had been sold twice since I owned it Shocked

last one from 2011 I ended up with a warrant out for not paying a fine for not renewing or paying road tax on a bike I sold 4 years ago
that I had no idea of as I was fined in my absence (I was living in Spain in 2011)

Haven't had it happen although I've only sold one bike, instead of having to go through this potentially happening just save the confirmation letter they send you and store it with other important paperwork.

What confirmation letter? That's the whole point.. if they 'claim' not to have received the V5 then how can they send a confirmation letter.

I had a letter telling me someone else wanted to register my bike and if I agreed do nothing... I done nothing and they still tried to take me to court for not sending off the V5

Voted 'Yes' before I noticed that you specifically asked about bikes.

I had to go to court once to make a statement under oath that I no longer owned a Ford Escort that was getting into mischief around my way.

AFAIK the guy I sold the bike to was driving it soon after I sold him it
how did he MOT it and tax it and get insurance if DVLA say I still owned it

Almost, not been fucked over selling, but have been fucked over buying before. TL;DR incoming.

I am offered the chance to buy a low-mileage KLE 500 for a reasonable price. Since I'm ready to upgrade from my 125, I accept. Previous owner sends off V5 to notify the DVLA of change of ownership (I know they did since they were a friend and I was present when it was mailed), I keep the new owner supplement while I wait for the new V5 to arrive with my name on it....

...and wait...

...and wait...

After four weeks I call the DVLA, they have no record of it and request the new keeper supplement to verify that I am the legit owner of the bike now. Not being a fool, I photocopy the new keeper supplement and send them that...

...and wait...

...and wait...

Another three weeks later, and after much pestering via phone, I am told that photocopies are not acceptable and that they need the original new keeper supplement, despite the fact that on the back of that slip it clearly states that I should keep it as it's the only proof I have that the bike is mine. I tell her this, she ignores it. So, begrudgingly, I type out a letter to the dvla explaining the situation, and enclose my new keeper supplement. I send it recorded delivery.

..and wait etc...

Another week passes. The tax on the bike is now due in 15 days. I still have no V5. I ring the DVLA and inquire what the flying fuck is going on. I am told to wait.

The bike tax is now due in eight days. Several more phone calls return nothing new. I am shitting bricks because I use the bike to commute to work and if the tax expires I will neither be able to SORN it or retax it. DVLA are still telling me to wait.

The bike's tax is now due in six days. My mate, the bikes previous owner calls me. He's just received a reminder to retax the bike he sold me over a month ago. Luckily this slip allows me to tax the bike for another year so I do that.

Two days later, my mate calls me again. A V5 has arrived for the bike he sold me. It's in his name and no details have been changed. I quietly vow to have Swansea carpet-bombed when I rise to power and we once again fill out a new keeper supplement, mail it to the DVLA (first class recorded)

..and wait etc... During this period I slaughter a newborn lamb at sunset and wear it's skin in the hope that it will appease the DVLA gods.

Two and a half weeks later, and many phone calls to the DVLA later, I am told the file for the bike has been amended to my name and an updated V5 is on it's way. I cheer with joy, success is so close at hand.

..etc...

Another week and a half has passed. Still no V5. The line now touted to me down the phone is that the V5 is on the way, presumably by bicycle direct from Swansea because it is taking fucking forever. I consider slaughtering another lamb, but used up all my kitchen towels cleaning up from the last one and don't want to make a mess again.

-at this point I do the worst possible thing you can do, which is forget about the matter- Five more months pass, and because I am a cheapskate bastard i only taxed for six months. The tax is now due in fifteen days. I begin to make panicked enquiries to the DVLA. Their records show I have recieved a V5. I retort that I have not. They suggest that it has been lost in the post, but luckily for me, and for the low, low price of £25, I can choose to play again. While I am being transferred to the replacement V5 centre, I mentally surround the DVLA head office with roadside bombs and imagine the gnashing of my teeth is the sound of feckless DVLA workers exploding.

Four days later, A V5 arrives. It's for my bike. All the details are correct. I cum everywhere. I tax the bike. All's well that ends we...

Two days later the thing my signature eludes to occurs. The bike shits the bed. I weep.

I knew I should have sacrificed more sheep.

To be honest I've still not received the V5 for the zxr yet, even though I've insured it in my name... I think the DVLA are just avoiding me at the moment, even when I try to tax the GPz online it's throwing back 'recent change' errors although I did change the address and colour on the same day I sent my license application form back (about December 5th)... and I got the new V5 back.

I think the main thing with all this kind of DVLA crap is let them play their little game, get to the point where they drag your arse into court and provide all the proof the judge needs to show you are no longer the owner... make a day of it, call all sorts of related witnesses, bring all sorts of documented proof so you can't lose... then laugh as the case is thrown out or is found in your favour and the DVLA look like a complete bunch of c**ts again

I've moved house twice in the last two years,

Re registered the car to our new address with no problems,
wife's licence came back for our door number (26)
my licence came back for door number 26A, there has never been a 26A and I never wrote 26A on the forms - infact I had the wife write out both licences and the car's V5 so that the hand writing was readable since my writing is crap.

decided to just live with it.

between that and moving again, bought the bike, changed the car.
only thing wrong with the paperwork so far is my license.

move house, send V5's off, bike's V5 comes back with my name miss spelt, imagine sheep spelt Seehp and you get the general idea of how much of a cock up that was, car's V5 isn't back yet

again, both forms filled out by my wife due to me having the handwriting of a 7 year old.

phone DVLA and the incorrect spelling can't be rectified over the phone and apparently the V5 for my car is somewhere on my street, but not my house and due to data protection, they can't tell me which house (I've got to know my neighbours well enough that if it's only next door I can nip and get it)

so, a new V5 appears for the car, correct address, correct spelling, I've got my bike tests coming up that I'm doing on my own bike so I hang onto the incorrect V5 for the bike and then send it off, in my handwriting with my name circled and the correct spelling written in large block capitals across the top of page 2 and correct spelling in the 'new keeper' bit

comes back, correct, with a note paper clipped to it asking me not to take the piss.

I've had a problem recently. Received a speculative invoice of sorts...

I sold a bike last year some time and sent off the V5 bits. I rang them a few months later for some other query and asked about not having received a response. I then sent them a letter as requested because they can't deal with it over the phone for some reason. Of course, roll on another few months and I have a 'fine' land on the door. Here's my response to that one:

I sold my motorbike (a red Hyosung, reg [removed]) on eBay around 24th Mar 2012 at the time I sent the correct part of the V5 to the DVLA. I no longer have the new keepers registered details, his user name was [removed] and phone number [removed].

Some months later after hearing nothing I happened to call the DVLA for a different matter and found there was no record of the transfer occurring. I tried to inform the person over the phone but she said she was unable to handle such requests. So, I wrote a letter similar to this one and sent it again to the DVLA.

Imagine my surprise now when I returned from an overseas assignment for Christmas to find a threat of court action for not informing you.

I have attempted 3 times to inform you, and as such consider the matter a problem with your internal systems. As far as I am concerned I complied with the requirements when I placed the correct sections of the V5 in the post. As such I feel any attempt to fine is wholly unjust.

Not yet but expecting something...

I sold a bike last week and sent the V5 off on thursday, first class signed for.

So far, nearly a week later, the royal mail tracking thing is still saying it is 'being progressed through the network for delivery'.

I'm starting to think that means "it's been lost".

I don't know whether to play the waiting game, or get the new keeper (my mate) to apply for a v5. I'm tempted to ring the DVLA and explain/ask if they've got it....

I don't know.

I know 2 other people that have received letters this last week demanding "bribes" for "not applying for tax" on cars they have sold a year or 2 ago..
