How can i replace this?

As a result of rust the gasket is now causing a leak.
So I'm wondering how should i go about replacing it with a new one?
Split the gasket then re weld or chop up the down pipes?

Take it you mean the header clamp/collar not the gasket?. It's a bit hard to see but is the collar proper knackered so you can't use a decent torque to clamp it up, are you sure it's just not the header gasket that's knackered as they don't last forever and leak, you don't bolt them up that hard to make a new gasket seal tight.
If the collar is proper knackered you'd be better off getting/making a new one and cutting the header to get it on then rewelding.
