Just want a bit of advice on this one really.

I shunted my car a few nights ago. Only had the car a couple of weeks, and coming into a roundabout the brakes didn't appear to slow me that much. Straight over the roundabout, into some trees.

My question is how do I go about approaching the dealer to get money back rather than having to go all the way through insurance.

I'm currently claiming on my own policy. The insurers have said they'll do a damage report and inspection which should throw up any potential reasons for the rta.

If there is a problem with the brakes then the dealer you bought the car off is responsible.

If there is nothing wrong with the vehicle mechanically then you will have to claim off your insurance and bear the brunt of it being classed a self fault accident.

Good luck, you'll need it!!!

Seriously though, you will have a major uphill struggle trying to pin the blame on the selling dealer, even if they are at any fault they are unlikely to roll over and admit to it. If you do come across some evidence or reason as to why the brakes may have not been working fully, you will probably have to take the dealer to court to claim the costs back.

Obviously the brakes must have been working in the past couple of weeks otherwise you would have brought it to their attention before now. That in itself implies that they were okay at the point of sale, which is quite a significant point in all this.

Unless you find some overwhelming evidence that the brakes failed, I wouldn't waste too much time chasing the dealer and you may have to chalk it up to experience.
