Ar, another new license laws power restriction question lol..

Right so, an old 400cc sport bike. Power when new was say, around 52bhp. So initially, to ride this on the new A2 license it'd need restricting right, as it's not legal as standard?

But this bike is 23 years old, with around 35k on the clock, probably not running as dreamy as it was when it left the showroom - it's gonna be down on power.

Say it was dyno'd in it's current state and fell within the 46.6bhp limit.

Now what? I know the restriction 'certificates', dyno printouts etc are all pretty useless, and a lot of people are saying the most official 'proof' is something signed saying that a restriction kit has been fitted by a garage / mechanic.

Obviously if no restriction kit was needed to make the power legal, this signed document won't exist.

So what would you do? if anything as to happen (scrutinized by the police, asked for proof in the event of insurance claim) would you just hope to explain the the above?

I've a feeling that if the bike was say, written off or stolen, and I couldn't provide anything to the insurance to say it was already within the legal power, they'd refuse a payout, cause it certainly couldn't be dyno'd if it was in 2 pieces or flat out disappeared. Same with the cops, if I was to get done for anything and the bike taken off me, they're gonna want to know it's all above board or else do me for riding out of my license limits or whatever..

Confusing situations eh. Any thoughts?

If the police wanted to prosecute they would need evidence, the only evidence that would stand up in court would be from a dyno.

Makes sense, I'm more worried about the insurance though...

I'll be on this bike for 2 years and we all know shit can happen in the early years - I also live in a bit of a dog hole so theft is as likely lol...

But we all know insurance companies will do anything to avoid paying out..

Hi

Consider where the power is measured. Dyno will measure rear wheel power, and may try and guess crank power from that. The law probably means crank power

What the Japanese makers marketing were using is another question!

Cheers guys, kinda put my mind at ease a bit.

I'll probably get a dyno printout anyway, they're £40 at my nearest place and I think I need some jetting adjusting so may as well get it done at the same time.

Insurance companies view the certificate as proof that a kit was fitted, possibly, at some point.

Sometimes they will have a nosey in the engine for a kit after a crash but on a stolen and recovered bike they could claim there is no restrictor kit in, all you do is moan that it's another thing to claim for and add it to the claim (whoever pinched the bike took it out honest)

Or you could dyno test it and have a garage sign that the engine has been de-tuned to 46bhp since the wording is that it can not produce more than 46 and can not be restricted down from a bike of 72+

It does not say how a bike is to be restricted.

PaddyCerttm it, say it came with the bike, I guarantee it'll never be an issue guarantee is not legally binding.
