PostPosted: 22:35 - 04 Mar 2013    Post subject: Contesting parking fine Reply with quote

So I was popping round to see my step dad tonight to collect something and I parked my bike by the pavement round the corner. This was at about 9pm and as I was coming back to leave around 10pm I had a parking fine stuck to my bike. I opened the ticket and It said my bike was seen at 21:21 parked in a restricted street during the prescribed hours.

Now I could be wrong on this but there only a small sign on the street saying 8am-6pm so I took that to mean outwith those hours it would be ok to park there?

I'll try post some pictures to show you but what I'm wondering is should I contest it rather than paying a £60 fine. Could I possibly say that it was parked somewhere else but someone had moved it there if that would work.

Anyway if you could help that would be great.

Photos of sign or lack of

Permit signs must be clear and clearly show what permit and hours

Get on pepipoo or whatever it was as someone will know the legislation.

Does the ticket specify whether it's for parking with no permit?

That sign has an arrow to the left, meaning restrictions in that direction. I wonder which sign and which restrictions cover to the right of that sign as it's not obvious from the pics.

<edit> is that a double yellow I spy?

Council yellow slap on ticket, I don't fancy your chances fighting that one bud in all honesty. Sad

No the only reason that was written on the ticket was "parked in a restricted street during the prescribed hours."

Yes unfortunately it is a double yellow, but i would have thought that they would have written that on the ticket instead if that were the problem?

The restricted hours for a double yellow without an accompanying yellow time plate plate are 24 hours a day/7 days a week.

Are you sure it's a public highway though, the red sign behind suggests it is a private road.

You're right, perhaps he was thinking of other things while he wrote the ticket and hit the wrong button.

You might be lucky and get away with it because of that. Appeal to the email/address stated on the ticket and get a photo tharen in the daytime that doesn't have your bike on it (because it was dark and you couldn't see properly at the time).

Argue first that the ticket is clearly incorrect based on the sign and the time on it and hope they overlook or don't have photos from the warden. If that fails and they mention the double yellows then argue it as a technicality... They are after all accusing you of breaking a law, they should at least pick the right one.

You'll normally get it dismissed on your second appeal. I've had 2 council fines and both have been successfully appealed with a simple letter and photos.

Always appeal a parking ticket, the worst you will get is a few extra weeks to pay it.

that's a bit contradictory,

The yellow sign for the single yellow line clearly states no parking between 8am and 6pm, It's dark thus it's after that time.

The red sign, I'm not sure is legally enforceable, more of a "don't park here" although you can prove that you were visiting a resident so in my opinion should void the red sign.

no mention of permit needed.

what does the mob on pepipoo say?

Get a picture of the lines where they change from double to single and read this page carefully.

A restricted road means a restriction on waiting or loading, i.e. single yellow, double yellow or kerb blips.

I've posted the topic on to Pepipoo (cheers for the link) and i've also taken some photos of the ticket which are on my photobucket as well now. I will have to wait until tomorrow morning to get the pictures of the street as its just about to get dark, from what i can remeber though i don't think i saw a bar between the double and single yellow lines but i will see tomorrow.

Just throw it away.

If you ever hear anything further just say you never had any parking ticket. If you do you could say kids must have pulled it off or something.
