PostPosted: 00:01 - 23 Mar 2013    Post subject: Bike knocked over Reply with quote

Yesterday i answered the door to a girl who had reversed into my bike.

She admitted it was her fault and i have a video recording of that too, she did say she didnt see my bike, which she would have if she had looked.
She had already moved her car from where she hit it so i dont have pics of that but i do have a pic of the dent in the back of her car.

We havent told the insurance companies yet as i said i would get it checked out and get a quote for the damage.

I got it recovered by autoaid and taken to my local bike place i use.

I got a quote from them for all the damage which will right the bike off if it goes through insurance.

Now i dont know what to do, im not that bothered about the scratches to the fairing as there were a few already but i do want the dented exhaust replacing as well as the mirror, barend, throttle assembly, indicator and brake pedal.
If she gave my £500 i could fix it back to how it was and live with the scratches and keep it from going through insurance.

Or it goes through her insurance and probably gets written off.

I dont mind it getting written off as long as i can get it back which isnt guaranteed as i have spent quite a bit on the bike in the last year on things such as having my suspension done at MCT which was £500 and ive just bought new downpipes which were about £200 with all the gaskets etc also ive just bought a new hugger to fit which was £80 plus lots of other stuff.

I'm going over to the shop tomorrow to get the written quote and then i'll pay her a visit at home as she lives a few doors down from my gf and see what she says. Bear in mind i think shes a single mum with 3 kids so probably has fuck all money but my gf says her mum is well off so....

What would you do?

Confront her with cash repair price.

if she dislikes, say obviously will need to go through insurance.

Save recording and obviously get her to sign paper to say she is aware of recording Smile

Well I've had a very positive experience with getting my bike written off after my neighbour reversed into it Laughing

Quote for repairs + whatever you think the scratches are worth to you. If she doesn't want to do that, go through insurance, try and get her to sign something saying she did it. I don't think that will actually be that big a deal since your bike was parked. My claim went through no problems even though I had no evidence.

Be nice to her though, will make it more likely that she will admit to it to her insurance.

If she doesn't want to pay, go through insurance, they will most probably let you buy it back and hey presto you've made yourself some money. And a non fault claim makes very very very little diffeence to your policy (or to my policy atleast). Costing me £5 more a year because of this claim.

I actually ran a few quotes earlier and some of them were cheaper with a no fault claim on Shocked feckin stupid insurers im sure then just pull random numbers out their asses.

Any ideas how i can get her to give me written proof it was her fault without sounding like a dick Laughing

I'm afraid I'm not that silver tongued Laughing

Btw, I dunno if you have the option of who deals with your claim, but Bikers Legal Defence dealt with my claim on behalf of Swinton Insurance and they were utterly brilliant. Would absolutely recommend them wholeheartedly (BLD that is). Very professional and I had the pay out for my bike within a month.

Swinton on the other hand Rolling Eyes

Not necessary. The law requires that one of the recorded parties is aware that the recording is taking place - the OP was one of the recorded parties and will obviously have been aware of it. Thumbs Up

if possible you could ask for sexual favours + £250 towardf the bike being fixed, be convienient for you as your GF is only a few doors away, plus she has 3 kids so thats evidence she'll take it bareback.

What law's that? As far as I'm aware, there's no offence of recording a conversation that occurs in public. The issue is sharing that recording with anyone else without the consent of both parties.

I wouldn't bother with trying to get an admission on record, she sounds like she's easily persuadable (3 kids, no ring on it...). Best if she gets on to her insurers and admits it to them and they sort it out with you. Any strife, get a claims management outfit on it, it won't cost you anything.

Sorry about the bike, by the way.

Well i offered her the option to pay me £500 to get it sorted and gave her the weekend to decide.

She text me this morning to say shes gonna go through insurance.

Shes going to ring her insurance and she has all my details shes also going to ring police for a crime number ( i dont think she needs to do this but whatever)

So what do i need to do?

she hit my parked bike
she gave me her details
shes reported it to her insurance

Do i need to ring my insurance or ring the police etc...

Will i get the choice of what the claim is for? as the bike will be written off if it goes over £1500-2000. The garage quote was over this. And thats not including fitting, their inspection, i'd also want a courtesy bike if this is going to take weeks/months to sort out.

I also have a aftermarket exhaust, brake levers and rearsets that were damaged, will i be able to claim these or will they only repair with standard parts?

Thanks

Gutted, get everything checked over closely mind. Some dozy bint reversed into my Sprint the other week, at first I thought it was just light damage to the mudguard and as such only pushed her for the cost of getting a non cracked one off ebay. I then promptly realised that the head race bearings had a nice big notch in them too. Sad

Ring your insurance before they hear her presumably faux side of the story first.

Well i waited all day for a call from her insurance but didnt hear anything so i got in touch with mine and informed them what happened and sent them my pictures.

Bikers legal defence are now handling it all for me and i'll have a courtesy bike here by Wednesday to use until this is all sorted out.

Seems like she hadn't reported it so i dont know what shes messing about at.

Im just hoping they wont write it off. My underwriter estimated my bikes worth about £1200 so its very likely, they best let me buy it back off them at least.

Are you sure your not going to have to pay for that hire bike?

If she hasn't reported it then she clearly hasn't declared fault so at the moment I don't know who has to pay that cost, and it ain't cheap Rolling Eyes

While this incident is straightforward in theory,it can all go tits up if she makes some fantasy story up.

Daft cow, but it'll be her insurers (and thus us) that lose out.

Have you kept receipts for travelling expenses up to now? Add them on.

Bikers legal defence said they get the hire bike money off her insurance and under no circumstance will they charge me, they dont give out hire bikes unless they're sure they will get paid from the other parties insurance or they pay the costs themselves.
I have photo evidence as well as video, audio and text messages all showing her as the guilty party. Thumbs Up

Her insurance rang today saying they were taking full responsibility and paying for the damages, even though they hadnt seen the quote.
The quote is about the same as they valued the bike at.

Hire bikes gonna be here in the morning Blandit 1250 Neutral looks like a barge with 2 wheels.

Anyone have one? Its about 50KG heavier than my CBR so thats not going to be fun pushing about on my front lawn.

Unless you've declared the aftermarket parts as modifications when you insured the bike they won't be covered

You can record, say a telephone conversation you have with someone else and not tell them. This is ok because one party, yourself, is aware that it's being recorded. It's not deemed to be a covert recording. Sharing this without the consent of both parties isn't a problem as far as the OP is concerned - permission isn't necessary at all.
