Basically, my contract phone is shit, and pay as you talk is better for my finances....is there a way I can cancel, or do I HAVE to keep it for a year?

You can probably cancel it, but you'll still have to pay for the year which kind of defeats the point.

or you can cancel, but you have to pay the outstanding, i.e., if your 8 months into a 12 month contract, and u cancel, you have to still pay the outstanding 4 months.

I got my last phone from carphone wahrehouse on contract, and took out there insurance.

In it was a 'contract breaker' deal, that allowed me to just return ther phone etc.. exactly how i brought it and everything would be cancelled (had to have it for 90 days)

I did this after about 4 months and started a new one, with a better phone.

By Law you have 7 days to change your mind on ANY Contract, so if its within this time they should cancel it with no penalty what-so-ever

With some companies such as T-mobile, you may have a 12 month contract but you can change to a different pricing scheme after 6 months.

Unfortunately this isn't the case Craig. Unless stated otherwise in the terms and conditions (which is very rare), contracts signed on retail premises don't have any cancellation period unfortunately.

They'd be breaking the law if the didn't offer that back out clause.
It applies to any contract as far as I'm aware, As I did it with my broadband etc and I know for a fact I could when I got my O2 phone, if I sent it back within 7 days It would be cancelled, but If I activated the phone then I would have to keep it.

I was told that you have 14days to cancel a phone contract, i took one back cus the phone was mis-sold. Dont know if you can just say you dont want it anymore.

Consumer Rights act does allow you to take a phone back after 7 days, but only if it was mis-sold or faulty etc.

Some Companies will go above and beyond their legal obligations to customers and consequently offer a cooling off period as part of the stated terms and conditions within their contracts.

However, from a legal standpoint there is nothing specifically written that states that once a contract is signed on retail premises (it's slightly different if you sign a contract at home or away from trade premises) you have a cancellation period.

The problem with 12 month phone contracts, well on O2 anyway is that you can't even upgrade your mobile, I am intending to keep my contract after the 12 months are up, but I really want a new phone, because mine is dodgy!

What I have done is say I simply can't afford to pay the contract any more and can they change me to Pay As You Go. That way they're more happy because they keep you as a customer

Yes, like others have said, you have to stay on the contract for the year. I'm in the same situation. I called them to see if I could cancel my contract and they said I could "buy out" of it. But it works out cheaper to go on the lowest tarriff available and just not use my phone (I have a pay as you go which is loads better). As soon as I can cancel my contract phone I will.

contracts are gay. My mum had a *free* 3310 plus 200 *free* texts a month. They modified the 3310 so that it sent like 5 texts instead of 1, so when i got it, it munched through credit in days. Believe me get pay as you go, no line rental, you can keep a sim for years (mines only got a 10 message capacity its like 4 years old) and its been in about 10 fones over the years, if not more.

Without reprogramming the IC's on the phone circuit board there is no way they could do this.

More likely just set up incorrectly on the phone.

I took it to nokia shops etc, it was modified. There were no settings. It did the 201/1 characters thing, you get to 160/2 etc etc. It was sending the linked messages thing, but like youd do 30 characters and it would send two, and it made you think when youd kept it short enough to say it would send one it would send one, but infact it sent two. And if you used the full 201 characters youd send 3/4. And they would turn up over like half an hour, out of order aswell. Drove everyone nuts. Hence why i got the 6210 again off ebay, one text =160 characters. My credit lasts a good couple of weeks now. Not a couple of days.

Cheapest way out is to drop the contract down to the lowest tariff possible and buy it out from there.

I used to work at singlepoint, when you start a contract you have a 14 day "cooling period" if you don't like it you can return the phone and cancel the contract but it has to be within 14 days! Thumbs Up
