So, some of you may remember, at the end of January, I was knocked off my bike. soon after United Assistance Ltd uplifted the bike and took it away (at the instruction of bikesure, now it seems i should have kept it with me)

Now, the bike got category c'd and I was offered £1200 for it, I accepted this.

The cheque I received was for £1000, and they seem to keep dodging the remaining £200, at first saying it was the scrap value of the bike, and that I have the bike, so I wasn't due the remaining £200.

Since then, all I get is ignored, I do not have the bike, they took it. Now, in my (poor) view, this is theft, they have stolen my bike, or stolen £200 from my payout. Where do I stand with this? can I report the bike as stolen as it seems the £200 is the scrap value given to the bike? I'm getting nowhere being polite and about this.

In other news, my medical was due yesterday, and got canceled at 9PM on Sunday, I'm pretty pissed off about that too, the notice is just not acceptable in my humbled opinion. Alas, it seems the insurance people are having fun fucking me around. I can see why people rinse insurance for everything they are worth now Confused

They are right, £200 would have been it's salvage value, you get the payout for the bike minus how much you'd get for scrapping it
something like that, it's confusing

Be happy with your £1000.

Surely if they'd taken out £200 for salvage, I should have the bike back?

Not excess on claim is it?

If they fail to resolve, then raise it as a complaint. If not resolved after 8 weeks then you can got to FOS for a ruling.

Given that will cost them £750 it will sharpen their mind to resolve.

There's no excess for me, the third party admitted liability, and police found her at fault.

It's been well over 8 weeks now, so it looks like a complain to FOS seems to be the next step, Thanks Thumbs Up

You HAVE to complain to the insurance co first. Make sure they open a complaint and advise them £200 has been deducted for salvage and as such you expect the salvage to be delivered with urgency.

If, as I suspect, the salvage co have broken the bike up etc, then you expect the £200 to be issued to you along with compensation for distress caused.

Once you recieve the 'final response letter' from your Ins Co, THEN you can go to the Ombudsmen if you are still not happy.

Yes, you should get the bike back!!

I had the same thing with mine, comp for 1200, £1000 cheque, 200 deducted for scrap and the bike returned to me, which was then sold
They shouldn't break the bike up or do anything with it, you should get it back as they received it

I assume her insurance? Can do, my complaint has been with United Assistance Ltd since it started.

United Assistance appear to be a Claim Handler possibly brought in by the 3rd Party Insurers.

Who were they insured with? Complain to them.

She was insured with ageas insurance, Take note, if you want an insurance company to fuck your victim around, these are your guys!

I'll take my complaint to them, I've fired off an e-mail, and will be writing a letter and sending recorded/signed for.

You didn't do something rash like cash the cheque, which would have been sent as "full and final settlement"...?

If you weren't happy, you should have sent it back or shredded it and told them to try again.

I have cashed the cheque, as I had no other option, I had to pay rent, and they had already delayed payment. However, there's been no mention of full and final payment.

It wouldn't be surprising for them to pull that now I guess, if it comes to that, I'll continue with the complaints procedure Neutral

Nonsense, if they have paid out on the understanding that he retained salvage then that is incorrect. Final settlement does not apply in this instance.

Let's see. Do expect to be asked why you cashed it though, and I'd suggest that you revise your answer to be "on the understanding that the bike or its salvage value would follow immediately."

Funnily enough, I've had a response to my e-mail, still sending the letter though.

I wasn't rude in the mail, nor was I all hugs and kisses, but it seems it may have done the job, some random other company has come into the picture now, these guys (bankstone) apparently have the bike. They state they had tried to contact me already by mail and phone(which is utter toss, but it's a company right? they don't have to be honest!)

I now have a form to fill out and send back, I'm tempted now to ask for the bike back though, as if they've already stripped it for parts...

Anyways, looks like cashing the cheque has had no bearing on htis, for now at least. Thanks guys for your input and advice Thumbs Up
