And received a brand new phone in replacement. Lock button wouldnt work if either end was pressed. Only worked in the center. Its an instant warranty replacement.

My pencil went blunt so I contacted the manufacturer, they explained that sharpening it was a user capable maintenance task. Should I just sharpen it or go to court for a refund?

That would depend, are you an approved sharpener licence holder?

I think it depends more on if he's using an official compatible sharpener. Ever since the Pencil 4B came out, offering darker shading and a Comfort-o-scribble softer lead than the previous generation 3B, a lot of users have found their old sharpeners are incompatible or cause the lead to break.

I only use the isharpener V4.7, it is made of real nice smooth white plastic and one you use it you know your day is over due to compatibility issues.
My, pencils are now all blunt but for some reason drawing a high price at auction.+-
