PostPosted: 15:04 - 07 Oct 2013    Post subject: Police cautions Reply with quote

I am a little bit worried.

The other day I was riding home from work on my TTR 250, I have just changed the sprocket sizes, 13:52, as I primarily do town work and mud, so do not need top end. Now, there was a bit of a traffic jam, and as the traffic got moving, I fluffed up pulling away and sent the front wheel up in the air and brought it down almost immediately.

After this, I checked around as I was worried about police. It was all clear, or so I thought, behind me was an undercover black BMW 5 series with slightly tinted windows, black interior and obviously police wear black clothes. So I did see the police and didn't register it, for some reason I carried on moving and popped it up again, just to see if I could do it in 3rd, as I couldn't with the previous gearing.

Sure enough, the sirens come on and pull me over. Fortunately, I had just changed the plate to legal size, it was about 3X4 or something stupid before and I had fixed the brake light at work about 10 minutes before that. Everything checked out fine, I explained to them what I just explained and they said that I seemed like a nice enough lad and would just give me a caution.

My question after all this is what happens with that caution now? Will it go away after a certain period of time? Will it stay with me forever, will it follow the bike around? I don't know and in my state of euphoria after being told it was a caution, my mate lost his licence for doing a wheelie, I forgot to ask them about this. Does anyone know? I tried googling but I couldn't find anything.

Thanks in advance,
Adam.

Sounds like you got away lightly.

Learn your listen though.

Don't go popping wheelies in front of police cars. Wink

And where or not it's recorded on the PNC will vary from force to force. The recommendation is 5 years, but they can do as they please.

I think it depends on their definition of "caution". Cautions are definitely (mostly) recorded, (at least in GMP) but did you have to sign anything, or did they spew out the arresting caution? (you do not have to say anything etc etc)

Thanks you lot.

That grammar poster has cracked me up.

I did think that cautions are a bit of scaremongering, from what I could find. He did say that it would be on the database but it has the bike on it so if the bike went then surely it would no longer be on the database? I'm not selling it any time soon but I think that it would disappear if they put the plate in to their device and it didn't come back as me as the owner any more then surely the caution is gone?

I'll just pick my wheelies more carefully. I mean, stop doing them. Wink

You would know if it was an official Police caution. It sounds like 'words of advice' to me. Its more like "don't do that again sir, think of this as a warning/caution."

As for it being on a database, I would very much doubt that. You need to sign for an official caution.

I suspect you just got a telling off and a verbal warning, rather than a "caution." It's unlikely that anything will be recorded on police systems other than a record of any PNC checks done on you or the vehicle. Unless they gave you a Section 59 warning, but from what you describe being told, I don't think they've done that.

I don't think you need to worry.

yeah I got caution off the police today, accelerating down the slip road to join the motorway , saw a gap was going to be there by the time I got to the end of the slip road and pinned it .. then saw the blue light so pulled up on the hard shoulder .. got some sarcastic comment about doing a faster than off a starting grid . Then let off with a warning that acceleration still constitutes a speeding offence and hitting well over 120 up the slip road was OTT. warned to do things less aggressively then sent on my way ....

Genuine question......is this what REALLY happened? If it is then I do genuinely worry about your safety. Doing a wheelie by accident is pretty hard to do. Shocked

People get confused with cautions and warnings.

An adult caution will be noted on the Police national Computer (PNC) and if a CRB check is completed against you, this will be flagged up and must be disclosed to future employers.

You would have to be taken to police station to be issued with an official Adult caution.

By the sounds of things you had a warning. So forget about it learn your lesson and move on. Very Happy
