That is FANTASTIC, I hope he wins the case, not sure how in any way it's fraud if the document is there and signed by the bank.

heh i like the fact the bank are trying to counter for fraud.. no deception here, ignorance is no defence mr banker Wink

hope he wins.. perhaps the amount he's asking for is a bit ott and will probably be no where near that if he wins but i hope he does, clever idea

Good on him, but I suspect the fact that his terms looked exactly like their terms, and he didn't make any effort to draw their attention to the changes he'd made, might come back to bite him.

That would certainly be the case in the UK. When someone sends you a contract, the onus is on you to read it. If you make changes to that contract and send it back, you'd have a very hard time enforcing any of the changes if you haven't drawn their attention to it.

we discussed this in the office on friday and came to the same conclusion. unless he returned it saying his terms and conditions apply/agree to be bound by HIS terms and conditions then he'll have a hard time winning.

also if he's changed theirs leaving their layout and logos on then that's essentially fraud (backtracking what i said in my original post now i've thought about it)

will be interesting to see what the outcome is
