my dad was out taking a bike for its MOT. failed on a few things blah blah blah, mum starts ordering a few parts, my dad goes out with cash to pick said parts up. it came to some new disk blots. The dealer wanted 30 quid for some bolts, my dad said no that's a rip off i don't want them. So the dealer calls up my mum and said as the order has been processed for pickup you need to pay a £9 restocking fee..

now.... the fucking bolts hadn't even been taken from the shop so how does a restocking fee come into this. shall i just refuse to pay it? are there any sections from the sales of goods act about items not leaving the shop i can chuck in when i give them a call?

any help is good as my parents are going into fucking meltdown over it. mums saying just pay it. dads refusing to pay it. im like fuck it...

I've never heard of a restocking fee of over 10 percent, if they really want to pay i'd offer 10 percent.

Personally i'd just walk off and tell them to stuff it Laughing

Its fucking bolts at the end of the day, its not like they had to drag a frame off the top shelf with 4 guys Rolling Eyes

It will fall under Distance Selling Regs as the order was placed over the phone. I'd have told them to shove the whole order up their arse.

#1 The DSRs apply, and make no allowance for "re-stocking" fees or any other such noncery. "The contract shall be treated as if it had not been made."

#2 Even if they didn't apply (and they do) where is the contract that shows that your mum made an informed decision to agree to pay that? Oh, right, there isn't one.

#3 Even if the DSRs didn't apply (and they do), and they had a contract (and they don't), what exactly are they going to do about £9? Pass it on to a debt collection agency, who'll send one nastygram and then forget about it?

Your mum is being mentally ridiculous. Is she related to shereen by any chance?
