It would be easy if they weren't so small, not worth the effort on a 15KP image. Only thing it's good for is Faceshit and no one on there gives a crap if your pictures have words on them. ____________________ Current Bikes:Honda 929RR Fireblade, Honda CD200 Benly (Project), Stomp Z2 140

Contact the photographer and tell him you understand he's been trying to make commercial use of your image and property without a model and property release.
In this particular circumstance, you'd be prepared to settle the matter with copies of the photos, and him deleting the originals, plus a 25 quid admin fee. Otherwise you'll see him in court!!
Joking aside, I would have thought this would be true, unless you explicitly signed some kind of waver when booking the track day (it not being a 'public place' he may have some kind of get out, or he could argue that you are not identifiable). I don't *think* in the UK you can take photos of people (even in public) and use them commercially without their permission. However there are exemptions for personal or editorial use (e.g. news stories, which this isn't).

Model release is not required in the UK; I can take pictures of whomever I like in a public place and publish with impunity (within the bounds of decency and legal conduct). It seems Australia have a similar approach. Also, 'commercial use' of a photograph is considered using that photograph to sell something other than the photograph itself.
Furthermore, publishing images taken by someone else without their consent is a breach of their copyright. It is unlikely anyone would actually chase you for it, but they are entitled to. This is, of course, why they only provide low res proofs with watermarks on, to tempt you into purchasing without giving away the goods. |
Yeah, but the photos aren't that spectacular to be honest. Maybe if they'd managed to catch me scraping my elbow, but they didn't. ____________________ Blue_SV650S wrote: it was a sh1te wheelie, but it proves that he can get it up in 3rd and can do angles. Ah, that's interesting, I hadn't come across that distinction before about the putting the photograph itself up for sale versus using it to sell a product. When i did microstock I always had to do model releases unless it was specifically for editorial, probably because they can be used in lots of territories, and the need for the publishers to cover their asses. I know the privacy laws do vary from place to place, France I understand has very strong protection of taking photos in public after the Diana thing.
But does that mean that in the UK if someone takes a sexy photo of my gf at the park, they can sell it without her permission?
It does seem a bit of gray area, and a tricky one for the photographers! |

You can't restore data that aren't there, especially on that size of image.
You can first remove the branding with (e.g.) GIMP and heal selection. That works tolerably for largish randomish areas like the gravel and to a lesser extent the track, but when you get into the bits that you care about (you and the bike) it'll spazz up and you'll need to sort it manually.
I did a bit of smudging here, but got bored after a couple of minutes. That right arm needs redone almost from scratch, and at that point you're really just faking a CGI impression of yourself.

That's about what I managed, if it was for a small size on facebook or something you can almost get away with it, especially if you apply a wonky filter to deliberately muck it up because it's arty.

ah right, I thought it might be as simple as say removing a layer.
awesome efforts though, thanks. Facebook picture worthy for sure. ____________________ Blue_SV650S wrote: it was a sh1te wheelie, but it proves that he can get it up in 3rd and can do angles.
