It would transpire that a dismissal is lawful even if the following is proven.
No proof of guilt,
Respondents caught out telling lies
blatent ignoring of HSE guidlines and no policy stating that in writing.

If the company has gone through the disciplinary procedures and changed their minds over what the actual "crime" is, as long as the person holding the appeal believes that they have grounds then thats all a company needs.

So be aware that if your company flouts the HSE rules and you get sacked for following them you are not garanteed justice.


So Weatherford UK Ltd, you lost a brilliant employee who never took a day off, was never late, worked an average of 55 hours a week and was popular with his colleagues just because his fuckwit supervisor didnt like him and lied through his teeth to get him out. If you wish to employ sheep who will never question the actons of useless supervisors then carry on, you are doing a splendid job. Evil or Very Mad
Oh that may give you a clue as to why several people left or asked for transfers after you sacked my other half.

There's always the civil action route to go down...but it's expensive and still not guaranteed to be a favourable result :/


It must be a common trait with oil companies though...
Without going into too much detail (for various reasons), someone I know used to work for one. They had to work on some machinery (owned by one of the 'larger petroleum industries') that they had never worked on before (2 of the machines on one site). Their supervisor worked on one, my friend was told by the supervisor to "do what he could" on the other and that he would finish it off when he'd finished his.
He didn't bother, it was switched back on, failed after a short while.
The owner of the machine threatened to cancel their contract unless my friend was fired.

I know its rife Andy, Im just feeling so sad that the little person always seems to get shafted. I hope that the woman sat in the public gallery from start to finish who works for the company was a bigwig as at least she saw the person responsible for getting him sacked being caught out in a string of lies.

On a positive note his name is cleared and he is happy where he is now. I have to let it go and move on and he does get his outstanding money from the breach of contract ruling Smile

Yeah, it's always easier (i.e. cheaper) to screw over the worker rather than the guilty party Neutral
It would be interesting if the woman is someone with influence and that the guilty one gets his comeuppance.

Sad times.

It sounds like to beat them you'd have to sink to their level though. They can't buy themselves self respect.
