 |
|
Bikes currently on SORN at the moment and its looking like I might not have the bike ready for a new MOT test before the old one expires in a week or so. Just to double check, is the following correct should the MOT expire.
I have to insure it as usual - can ride it untaxed to a pre-booked MOT test, and back home should it fail to fix whatever and then rebook another test.
If it passes its just a case of ride it home and then down the post office for a new disc and away I go Or would I be wanting to leave the bike at the station and going to the post office first on the off chance i'm pulled on the way home? |

As far as I know........ You can ride it with out tax and MOT to a pre arranged MOT test (though I'd expect hassle if it was 100 miles away!)
If it passes then you are ok to head to the nearest P/O to tax it, again if you start swanning around I'd expect trouble. I'm not sure about riding home and then out again to get it taxed but I wouldn't expect trouble if you have all your documents with you.
I'm really not sure about what you can do if it fails..... At a guess I'd say you are ok to ride it home (I've done this) but having said that obviously you have a document in hand to say your bike isn't road worthy.
Might be worth a google to find some legislation
Insurance is a must whatever.

In reality I could probably ride it to and from plenty of times without hassle as the MOT stations litearlly about 5 minutes from where the bike is, but want to be cautious and do it all legal as it would be a great time for karma to bite me in the ass and there be traffic cop parked on the road there
It should pass but my main concern was if it doesn't for whatever reason I don't want to be in a situation where i'm stranded at the garage at their mercy for getting anything repaired. They've been great for passing all my MOT's in the past on all my bikes, but their costs for getting anything else done are terrible compared to a lot of other local ones |

Just got this off "ask the police" website
Talks about car but bike is same.
A car must be insured, taxed and have an MOT to be driven on the road. The penalty for driving a car without an MOT is a fine.
The most relevant exception to this is if you are driving your vehicle to and from a pre-arranged appointment for an MOT and you must take a direct route to the garage (but the vehicle must be insured). Although you must be aware that most failures of MOTs are offences in their own right so you may be committing other offences, for example defective tyres, brakes, lights, steering, horns etc.
However if you are stopped by the police on the way to or from the garage the onus is on you to prove that you had a pre-arranged appointment. Where possible it is always advisable to book your car in for an MOT in good time.
There are one or two other very minor exceptions in addition to the above but they do not really apply to the ordinary car driver.
So from that I get you can drive to and from a pre arranged appointment but they can do you if things a defective!

I would.
VERA 1994 S22 (1) says "A vehicle is an exempt vehicle when it is being used solely for the purpose of -
(a) submitting it (by previous arrangement for a specified time on a specified date) for a compulsory test, a vehicle identity check, a vehicle weight test or a reduced pollution test, or
(b) bringing it away from any such test or check."
Away to where? It doesn't say, or even necessarily imply "home". If the nearest issuing post (or DVLA) office is closer than your home, wouldn't it be common sense to stop there and buy VED?
I say "common sense" because of Secretary of State for Transport V. Richards where the owner stopped twice on the way to an MOT without VED, once to buy petrol and again to buy cigarettes, and was nabbed for no VED during the 2nd stop.
Convicted at County, quashed at Crown, the court holding that "On the facts of this case, it is ridiculous if a driver could not stop to obtain petrol on the way. It would fly in the face of common sense if some short stop cannot be made by the driver, for whatever purpose, providing he is on his way to the test station."
I'd hope for common sense to be applied to "bringing it away" as well. ____________________ Biking is 1/20th as dangerous as horse riding.

The obvious plan would be to pull into said post office and request permission to fund the coffers and purchase the paper disc. But if theres a t'copper waiting outside, I don't fancy getting shafted as the licenses are pretty important.
