Today I pulled into a car park to check my phone real quick. As you go in there's a straight road and a small doctors car park to the left and a big car park to the right for a shop.

I parked just after the entrance to the smaller car park (no double lines or anything). Don't like parking in car spaces and I was only going to be there for like a minute if that. A head of me about 15 - 20 meters away was a skip truck in like a loading type of bay for a small shop ahead. I however was parked so the bike could be seen in the mirrors.

Next thing I know whilst I'm off the bike the driver has gotten into the truck and reverses it straight into my bike. I was standing to the rear of the bike and the bike on the side stand. I just grabbed the top box handle and dragged it back the best I could and kept it from falling. Luckily he stopped before he ran the bike over. Just snapped my front mud guard in half and scratched the headlight shroud.

The driver did however take the blame and gave insurance details.

TL:DR I was in the wrong lane on dual carriageway and didn't have any obs so I hit a car and damaged my bike

If you were only going to be there a minute to check your phone, why did you get off the bike? Why were you far enough away that you were unable to signal the driver to stop? Surely you were right next to the bike by this point so you could've ran up to his window.

On top of that, why did you park the bike behind a truck in the first place? There were probably a ton of places you could've put it. Bikes are small, they're easy to miss.

Basically you parked your bike in the blind spot of a truck in an awkward place and left it alone.

You should pay for any damage to his vehicle.

Granted I could have parked somewhere else.

It was a quick minute or so check and a reply to a text message which I needed to reply to. My phone was in the top box of my bike phones too big for jacket pockets it's a galaxy note, so had to get off the bike to check the phone.

However you could clearly see my bike in at least one of the mirrors on the truck. Not to mention there wasn't even a skip on the truck so it's not like his review mirror was obstructed by a skip and me a fat fucker standing behind the bike he should have been able to see either me or the bike.

And what do you mean I should pay for damage to the truck? It's a bike vs a truck not like it's going to do anything to the truck. The back of the truck also have metal wheels for the skip to roll over when loading and unloading. The rear left one hit my bike, so my bike will hardly damage the truck.

I got a phone call from the company who owns the truck who said they don't want to solve the issue through insurance and have agreed to pay for a new mud guard.

I get how people say I don't take advice but this is what I mean. I say one thing and you completely ignore what I've just said. Then get slated for not taking advice?

I was parked at least 10 meters away from the truck I wasn't like directly behind it and even if I had parked like 3 meters away you should still be able to see me or the bike. He could have easily have seen me or the bike in one of the three mirrors or have looked through the rear window whilst reversing. Don't see how I parked in his blind spot?

Well lucky you! The dimwit who clumped the back of my bike a few weeks ago in walking pace rush hour traffic told me it was my fault because I braked too quickly, refused to give insurance details, and argued the toss non stop with the police for a good ten minutes even after they'd laid down the law and extracted the insurance info from her.

Usually in these situations I accept the usual smidsy apology from the other driver and leave it at that. In this case though I reported it to my insurers (my god did the girl in their call centre laugh!), also a couple of weeks later I reported it to Ms. Dimwittys' insurers, just in case she'd 'forgotten' to let them know.

How do you know that ?

Were you sat in the truck and checked?

Just because you can see a mirror, does not mean its set so they can see you.

10 meters is over 30 feet. So given you must have heard it moving. Why were not keeping a eye on it.

This just goes to show how dangerous mobiles phones are and they should NEVER be used when you are in control of a vehicle Laughing Had you not have been texting. It would never have happened.

I wasn't in control of a vehicle I was off it? I'm also not a meter stick and wasn't really concerned at how far away I was, I just know it was a safe distance.

It's like if I parked a bike in the street and car or van etc would be way much closer to it yet they're able to reverse without hitting the vehicle behind them. As I certainly wasn't directly behind him and he had no skip on the back there was really no reason for him not to have seen either me or the bike.
