I can't believe it. Recovery charge. I'm going to tell them to recover it from the person who stole it as it wasn't my choice, hows that for some motivation to actually find the fuckers.

Gonna be a while anyway as they apparently are checking it for 'forensics'
It's been pissing it down most of the day and it's dark, I hope to god the fuckers crashed it and broke their neck. Honestly, 100% wouldn't feel an ounce of remorse as their mum screams and cries over their loss.

Rang the garage, need to speak to the office in the morning.

Guy said he had recovered 6 bikes from braunstone in the last 3 days.
I'm hunting victims on facebook and inciting a lynch mob.

Idea for a film: Guy buys bike on the cheap from some gumtree urchin "Sorry mate ain't got the V5 but av a word with the DVLA and they'll sort it" £200 jobby.

Guy wires up said bike to deliver lethal voltage in the event of an attempted theft/hotwire attempt. After each "shock" is delivered it sends an SMS message to a £1 unregistered sim card in a £5 phone. Leaves bike in bike theft hotspots.

Scrotes try their luck, electric shock stops their heart and they die on the spot. Owner is alerted to theft attempt, quickly trundles down to location, drives bike away from charred corpse. Resets anti-theft device and places in different notorious area.

Police scratch their heads as sizzled bodies keep turning up in the middle of the street for no reason, but no one seems to care, as the neighbourhood correlates this with a general increase in well being and lack of anti-social behaviour where they live, and over the weeks/months the local council notices the number of benefits claimants and births to single mothers are on the decline.

If corpse is found before owner has chance to get there, bike is unregistered, untaxed, uninsured and no MOT - pretty untraceable.
Police presume scrote nicked bike from somewhere, had some dodgy wiring and ended up killing said scrote. This calls for a coffee break.

Even if bike is examined internally, Sim card is untraceable, as this gets changed every time as does the phone/number it sends a message to.

So yeah, good idea for a film, be a shame if there were any copycats that turned fantasy into reality.....

Serious question as may prove informative for others.

I'm guessing at The Removal, Storage and Disposal of Vehicles (Prescribed Sums and Charges) Regulations 2008 (clicky link).
Charges are £150 recovery and £10 a day storage.

However, I've found in a link for Leicestershire police recovery police pdf if you if you click here. Says
Leicestershire Police wrote:
The police have powers under Common Law and Section 19 of the Police and Criminal Evidence Act to seize property that has been obtained in consequence of the commission of an offence or is evidence in relation to an offence. When these powers are used the cost of removal is paid by the police.

So if recovered for forensics that's investigation of a crime so comes under PACE so you shouldn't have to pay recovery fee. Probably still have to pay storage, they must get some monies.

Got theft insurance? Got theft insurance without a swingeing excess? It should cover you for damage and consequent costs, but you'll need to read your contract.

You'll want to read Road Traffic Regulations Act 1984, Section 102 (8) "person responsible". There have been several regulatory changes since then, but I can't see that the underlying statute has been amended.

I may be wrong though, I haven't read it that thoroughly. PePiPoo might be more help. You certainly won't get it back without paying the blackmail bill. The pound monkeys won't give a stuff about the law, because possession is 9/10ths of it.

If you choose to pay up, write "paid under duress" on the paperwork and then invoice them to recover the extorted money. You'll probably lose, the racket has been running too long.

If the bike is twunted and you've got a big excess, it may not even be worth it.

Sorry.

I guess, as you say about the impound monkeys, it'd be a case of suck it and see and argue the toss.

If the police have recovered it for evidence you dont pay. You only start paying once they release it.

The 2008 Regulations specify the amounts that are authorised by the 1984 Act (and the 1978 Refuse Disposal Act, but that's for abandoned vehicles).

As I read it, nothing in the Act (the underlying law) authorises recovery of the costs from the owner if they weren't involved in putting the vehicle in the place from where it was recovered.

That said, the reality is that we're not getting it back without paying, so they either have our vehicle or your money. I also wouldn't fancy our chances of a Magistrate or Sheriff being sympathetic to the wording of the actual law - that might have to be appealed to the Grown Ups at Crown and above.

So pay up "under duress", then fire in with an invoice and take it from there until you get too bored or stressed.

From what I hear at Pepipoo (albeit not about recovery/storage charges), you may have some luck paying by credit card, writing "paid under duress", and then doing a chargeback. "May" because it depends on your bank how willing they are to consider it "paid under duress".

Could be worth a shot if they're refusing to release the vehicle though.

Why not get together with the other victims and buy an old trailie with a kickstart, you know the kind scum like to nick. Then load it with a GPS tracker and an RF locator. Pop said bike out on the road near where you live, and wait. Catch the bastrds at it.

If it's knackered you get to sign it over to the recovery rip offs and walk away paying nothing. If they are waiting for forensics there is no storage charge but recovery fee is payable.

Read the thread and you'd know.
My works car park (Braunstone Health Centre)
And braunstone park.

If you guys can work out the actual legislation.. I'm having a read of it, because i'm recovering it on monday morning at the charge of £150, and yes £10 a day if I don't pick it up before 12.

I asked some kids down the road just after I found it was nicked, they gave me someones name.

I now have said person's name, address and telephone number.
The slow sword breaks the shield. Wink

Oh and the ignition is fucked apparently and some panels have been ripped off...hopefully rideable though

Can you PM me the lads name? Wink

And honestly, they've only dumped it because they've trashed it. I doubt it's as simple as the garage make out. They often don't tell you stuff so you collect it. Rolling Eyes

If you know the lads name I could probably find him on FB through searching other scumbags that are known to be robbing them. Usually the thieves are friends or friends of friends. Rolling Eyes

And so they stole it from Hockley Farm Road? And rode it literally a minute down the road, and dumped it? How pointless. Neutral
