some bastid has managed to knock a giant red wheelie bin down a hill right into my paj Evil or Very Mad

Damage ain't toooo bad luckily, mainly a snapped footpeg hanger, a few scratches to the paintwork, a dent in the tank and a scratched exhaust..

so heres me story...

I parked my bike outside an indian restaurant, and popped next door for dinner with some friends. During dinner, i heard my alarm go off, ran outside, and found my PAJ on the floor, in between two cars, with the restaurant owner outside looking pretty guilty...

So, i ask what happened, and he tells me hes seen a car leaving at speed, and knows nothing more. Then, unprovoked, he says he saw some 'kids who just bought wine' (from his restaurant!) pushing each other around outside, and knock the bike over. I pick the bike up, check out the damage, etc. then decide to call the AA to get the bike home (as the footpeg hanger has snapped clean off!), and finish my dinner. So i go finish my meal, come back outside, and the indian guy comes out, and tells me the kids must have knocked the bins, as thats what caused my bike to fall! (the bins were against the wall this whole time, so he must have pushed them back pretty fast!)

I look at the bike, and find a small dent in the tank, with some red paint, and notice some red paint also on a car, parked just up the hill. So it looks like 'someone' has knocked the bins, which have rolled down the hill into the car, and on top my bike....

Now i cant really accuse anyone, as there were no witnesses, but from the way this guy was changing his story, and the way he looked very scared when i told him i was going to call the police to get them to take a statement, i have my suspicions about 'kids' being involved at all.

I'm wondering if he might be liable for leaving his bins unsecured on a steep hill, near official car parking spaces? Does he have a duty of care to secure his bins incase of accident etc?

and also - can anyone recommend a cheap place to buy a right side footpeg hanger from?

Sorry to hear that.

It is always wise to try to see the story from all sides, but without witnesses it will be difficult to find the cuprit.

Anyone else's shop overlook the bins?

Also, I was gonna have a check on ebay, but don't know what a "paj" is? Embarassed

dam sorry to hear that mate...just put a dent in the car that knocked the bins over, that way whoever it was will get their just reward....(im only joking-dont do it)

it wasnt a car.. i think the shop owner knocked em ova accidently then just blamed every one else.... the police are investigating for criminal damage, tho it wont go anywhere, as im sure they couldnt prove intent! (im sure he didnt mean to do it!!)

Im gonna get some legal advice as to whether its his responsibility to ensure the bins are securly fastened tho..

hope you get it sorted favourably in your direction, although im tempted to say that cos you left the scene you accepted the damage, but i really aint sure whether this is true, so feel free to flame me people.
