What do I need to do?

The buyer is fully aware of the collision and that it is a cat c write off. Do I need to inform the dvla? [/code]

As long as you make the buyer aware it's all good as far as the sale is concerned.

As for returning a cat c to the road. You don't have to do anything. Doesn't even need an MOT.

Which probably won't stay up for long. Probably worth getting a receipt signed when you sell if saying 'sold as seen, known to be cat c write off' or words to that effect.

All the best

My motorbike which i sold about a month ago was a cat c or d (can't remember which one) Basically you need to make sure the buyer is aware and informed and you just sell it like any other bike. Hand him the paper work and you send off your part and he will sort his part out.

If you return a Cat C car to the road it has to be checked over / have an MOT done to show it's safe.

You don't need to do this for a bike, it still needs a valid MOT to be on the road.

What offence are you committing if you don't?

There is no offence, no MOT needed to get it back on the road, it still needs an MOT every year though.

Oh, here's another one.

DOTTYDUCK wrote:

Why?

It's an offence (with certain defences) to sell a vehicle with defective brakes, steering or tyres or which doesn't satisfy the C&U regulations.

If you knowingly mis-describe or lie about a vehicle, that's a civil tort which (very much in theory) leaves you open to the buyer seeking a remedy through the courts.

But if it's roadworthy, and you simply omit information, what are the consequences?

Question may be rhetorical.

If anyone wants to buy a bike, they should be aware that it has 2 wheel and can fall over... it will have damage, same as a car has "shopping trolley" dings.

If it was cat c, I'd state it was cat c anyway, I'm a nice guy, I would have got it for a bargain price anyway.

Not for me Embarassed Found out after I bought the bike its a cat c (my fault for not checking beforehand I know). That leaves the dilemma of do I mention it when selling the bike? I fear if I do it will put people off, and I'll get stupid offers, like 50p + a pie. If I sell it to someone at work (few people are interested) I'll mention it, privately... dunno.

It's a case of if they ask, you have to tell, if they don't ask, you don't have to.

As to aany comebacks, there aren't any with private sales.

caveat emptor

And sending DVLA the tear-off to notify you sold the fecker.

If you're not au fait with selling A Cat. C process you may as well cover your bases and cross the teas and dot the eyes.

Although there are plenty to say you don't 'legally' have to inform them. It is one less hassle to deal with if someone comes knocking with a NFP later.

Hi

Cheat if you want to but I think you should treat others as you would expect to be treated yourself.

Therefore you tell the buyer. He or she then has choice to buy or not. There is no satisfaction in taking hard earned cash from someone knowing that the guy is not actually buying what he thought.

Iv'e run a business for years and am still doing so years after we started. Had we tried to sort change our customers we would be long gone by now.

Hold on there Bald Eagle, the OP sez, 'What do I need to do?

It's the rest of the Scrotariate who are playing Dodgy Buggers.

This forum is littered with Pikeys, don' cha no?

Very Happy

Hi

My comment was aimed at the few that would rather not be up front.

I think I would give the buyer a signed receipt and get him to sign a copy just dealing what he had purchased.

Like

One bike (Make) Model Cat C Reg Number sold on (date) for (£XXXX.XX). Sold as seen and tested by the buyer and no warranty implied or given.

My understanding is that if it is a private sale and the bike is in a road worthy at the time of the transaction then that is it.

As said above I am sure all other paperwork is as normal with or without the Cat C bit.

So, bare with me. Am I right in thinking that if you buy a perfectly good condition 'cat c', that was written off because fairing damage meant OEM replacements cost more than insurance deemed worthwhile to buy, it will continue to be road-worthy on its previous MOT, and that MOT would need to be replaced as it would on any other bike on its anniversary date.

Seems like a lot of cat c's could be perfectly useable if thats the case. I've tended to avoid even looking at them in the past out of ignorance - or is there implications with increased insurance/finding anyone willing to insure a Cat C at all.
