Basically had a crash i've been driving for about a month and i'm going round a small roundabout going straight and i'm following the traffick and i car hits me from the right...... i know i know


Basically i kinda thought she was giving way and didn't apear to be indicating either yet i should of come to a stop but by this time as it's a pretty blind corner i see her and i'm already going over the roundabout as well, she hits into the side of me.

It's described by witnesses as a 50/50 and a failure to give way on my part but she should of been able to stop. Basically i cant remember the details vividly kinda bit shocked, anyway i get a call back from my insurance company i report the accident and tell them i don't wish to claim, i describe the accident and they said i'd probably be able to claim on her insurance as i'm only third part fir and theft.

They tell me even if it's a split fault i'll still be able to claim, what i need to know is if i should claim anyway will i have to pay my 200 excess even if i'm not claiming on my insurance should i claim on hers.

If it turns out to be my fault due to me being in experienced ect.. what happens then i cant claim? but does my insurance get raised ect..?

The damage to the bikes a lot more than the car, her cars basically fine and my bikes kinda screwed. 200+ quid repair if i do it myself.

I don't know what to do really i could be at fault however she wasn;t indicating should of been able to stop, i should of come to a complete stop and made sure it was clear however i was following the flow of traffick and she must of pulled out when it wasn't safe to do so.

Stripping away the dissembling, it sounds like you failed to give way to a vehicle approaching from the right on a roundabout, and that it wasn't giving a deceptive indication.

I'd expect to have that go 100% against me. Anything better would be a bonus.

You didn't give way to the right on an roundabout?

I am guessing it will go in her favour, You will have a claim against you, you will lose NCB, and your premiums will increase.

failure to give way... Makes no difference if she could have stopped or not.

While you have done the right thing informing your Ins co, you are going to be hit going forward.
Reason being she could well (read will claim) for damage to her car. Them bumpers cost a fortune to fix...

I think your ins co were just giving you the speel. Pretty clear as soon as you say roundabout and hit from the right. Who has right away and who's at fault.
