So had an accident a weekend.

Went sraight into the back of a brand new vauxhall corsea 2014 plate.

Been investigate by police and had a report back sayhing my brakes had failed!

Just came out garge last week after its MOT absolulty foaming!

Now wondering what bike to get ! after consideration I defintly want a bike move on from a scooter.

Budget is £1200 and want a 125cc Im 6'4 and rather on the chunky side Wink

Any ideas

You are aware a MOT only means that it is fine at that point.... Nothing else...

I was thinking that myself until I realised the brakes had no hydrollic fluid! only my fault for not double checking!

Are the police taking any action against you for using a vehicle with defective brakes?

Might go up.

If the brakes work on my car when I leave for work and for 90% of my journey, then fail whilst leaving a motorway, would it be defective and as such my fault. Wink

It would depend entirely on why they failed, if they took your vehicle and found it had no brake fluid in it and no leaks then yes

In that instance I would say it was entirely your fault.

was there a fault that caused it to leak out (faulty seal) or had you just never bothered to check in the last 12 months?

you did your daily checks as you were shown on your CBT before setting off?

I'll admit, I don't always check all my lights but my brakes get checked before I've got 3 meters away from my parking space.
