Applying for v5 dumped bike

Short version

bike been chained to a post for the past year and a half, not moved slowly rotting. tax run out 2 years ago no mot.

If i apply for the v5 and i get it can i cut the chain and take the bike?

It's like someone moving into your house because you went on a round the world trip for a year.

You could write to dvla with a valid reason for wanting the keeper details and offer the owner a tenner to take it off their hands

Well, if it has been abandoned would the owner have chained it up?

If the bike has truly been abandoned then taking it would not be theft.

I'd leave it alone.

The process of applying for the V5 for an 'abandoned' vehicle involves the DVLA writing to the last known keeper saying that someone is applying for the ownership papers, if they don't hear back or receive a 'that's fine' then they'll send out the papers.

in theory the person who locked it up there would be aware someone is going through the process of acquiring the bike.


however the V5 clearly states that it's not proof of ownership

Try contacting the owner first, leave a note on the bike with some way of contacting you or ask around the local area and see if anyone knows who it belongs to.

There's no simple answer to this one, we've been over it a few times. I strongly suspect that this is how it will play out:

Do the law abiding thing and report it as abandoned, and it will be taken away, crushed and the keeper billed for it. So don't do that. Instead, put a weather-proof note on the bike asking the owner to contact you while you start the following process.
Apply to the DVLA for keeper information ^[1]. I expect it'll be rejected.
Apply to the DVLA for the V5C (pay £25). I expect you'll get it eventually. At this point you have nothing but a massive liability. SORN it immediately.
Use the previous keeper details to try and contact them. Since he's been ignoring the DVLA nastygrams^[2] and the "are you still the keeper" letter, the chances of getting a response at this point are minimal.
At which point you'll have to cut the chain, and start living the pikey life. Hey, you didn't choose it.

Is it really worth it?

[1] https://www.gov.uk/request-information-from-dvla now explicitly lists "tracing the owner of an abandoned vehicle" as a reason. I guess they like raking in that sweet two-fiddy fee. I infer that they mean "for the purposes of harassing and blackmailing the owner", like parking vultures do, but it's worth a try.

[2] Presumably you've done a vehicle enquiry and it's showing as license due rather than SORN.

Just send a v62 with the frame and reg number, they will issue you a v5.

As bad as it sounds, they dont really care.

A friend had a CB250 stolen a while ago. Someone tried to register it after it was stolen via v62 as it flagged up on the stolen database, 200miles from where it was stolen from.

He went to collect the bike and took it home.

A few days later he gets a call from the person who he collected the bike from, saying a nice new v5 had turned up, in said persons name. He had also been informed that the person in possession before him, also had a v5 in their name!

So one bike, has 3 v5's, all with different owners names on.

Hasnt been taxed in 2 years 3 months, mot ran out august this year...

If OP takes reasonable steps to try and find the owner, he won't be thieving it.

Roger put the correct process up - mostly - talk to the DVLA, they have a form you can fill in, they will contact the current registered keeper. After a period of time, if they hear nothing back, you should be able to apply for a V5.

A V5 is not proof of ownership, so if you do get hold of it, don't go spending loads of money. The legal owner could just turn up and take it back. I would wait for a bit longer.

If you report it to the council, they will take it away and crush it. A while ago I reported an abandoned R125 around the back of my block of flats, I asked the council if they were going to auction it, part it out, eco-recycle it, or crush it. They were going to crush it. It was a good condition bike.

Don't talk to the council. If you genuinely want to rescue a vaguely rare little bike, do so, but wait a good while before spending any money. Remember that if it looks like it was owned by chavscum, there is a reasonable chance that the legal owner is serving a couple of years inside for cumulative chavscum activities.
