Morning,

Friday i got a letter through the post (PCN) from a company called "Park Direct UK" asking for £60 because i was apparently waiting too long at a petrol station. (6 seconds to be exact) I had pulled into the station on my way home from work to quickly tighten my petrol cap as it was rattling then i left. See picture below.

Well if 6 seconds is too long then i guess they make up their own rules.

What signs are there telling you about waiting times? Is there any way of you paying to park there? Were you on double yellows or are there any other parking restrictions in place?

If you genuinely were there for a few seconds to tighten your petrol cap and then went on your way trying to fine you for that is incredibly petty! If I were you I would be inclined to ignore it and let them take me to court.

Have you tried Pepipoo?

No signs, no yellow lines. I have this picture of me arriving and they have another one of me leaving with 6 seconds between them. I was genuinely there to tighten my petrol cap.

Letters like this really stress me out. What's Peppipoo? No i haven't tried them yet but will check them out.

Hold on, they gave you two time-stamped pictures showing you were there for 6 seconds? Hahahahahaha! Keep those safe and if it ever does progress further slap those photos down and ask how a 6 second stop (to make your vehicle safe) merits a £60 parking fine. I'm sure you could argue the definition of parked as you having left your vehicle and walked away, which you didn't as you wouldn't have had time to wander off.

TL;DR they are spacks, ignore.

They can claim whatever they want.. just ignore it (unless it's a local council/police).

I've had 3 companies chasing me at the same time for a period of time thanks to my wife's shopping habits. Letters were sent to registered keeper - me. I ignored them all. I was getting lots of letters with threats of taking it to court, kept them all for my record. Eventually they all gave up. Legally they had no leg to stand on. I was in no contract with the landlords and 'my' 10-20 minute overstay caused no damage to their property whatsoever. I was only waiting for court summons. Never happened.

Don't ignore court summons if they are stupid enough to go that route.

Do not bin it. The law changed a little while back and you do have to do a little bit of fighting against these pricks to put them back in their place.

Head over to consumer action group, pepipoo etc and have a read around.

I'm currently sat on top of a ticket for parking on the road in a "private" industrial estate. The dickheads put the wrong number plate in, so I'm waiting for the letter which has to arrive between days 28-59 of the ticket being issued (if they ever figure out they have the wrong number plate).


Do not ignore it. They can all be beaten, but it will not just go away like it used to.

Doubt they will try take it to court, but nothing stopping them from submitting it as the reward of somebody being stressed and paying is far worth the miniscule cost to issue the fine, sorry bribe.

I've got one from last February. They are now trying the debt recovery agency line, but there is no debt so they can whistle. I will wait till it goes to court even if I do have to pay the £100 just so that the have to work for it.

Don't panic mate, you won't end up paying anything.

Do not ignore the letter.

Hop across to Money Saving Expert, take a look here https://www.moneysavingexpert.com/reclaim/parking-ticket-appeals

It will take time and effort on your part but in the end you won't have to pay. Its a speculative invoice - not a fine or a PCN, no matter how pretty they make their little letter to you.

Read what is on there Carefully, when you make your soft appeal to reject their CONTRACT you need to ask them for a break down of their costs and proof of punitive losses on their part. Also be sure to notify them you will be billing them for all non exhaustive items such as postage and envelopes and also charging your time at the agreed court rate of £15 per hour Wink

They will reject your appeal - thats when you hand it to POPLA who in turn will cancel the fine... provided your appeal is good enough.

At the same time I would suggest you contact the owner of the garage (whichever company that may be) and make a well structured argument with them also. They should also have the power to call off the hounds and get your fine canceled.

Good luck... its just a lot of faffing about for nothing. Thumbs Up

Sorry, but "ignore it" is 2 years of out date. The hilariously titled "Protection of Freedoms Act" has turned out to be a charter for these footpads to mug drivers. At the same time, the number of claims actually going to court has rocketed, which is exactly what they said wouldn't happen.

DO NOT IGNORE. Better to nip this in the bud, unless you actually fancy a day in court. Some of these footpads are throwing thousands of cases (literally thousands) at the courts knowing that most people will either cave in or they'll get a default judgement (to which they are now successfully adding solicitor's costs).

Follow the detailed advice on PePiPoo, MSE or Parking Prankster, but in brief:

Do "appeal" to the parking muggers. Write "APPEAL" at the top of your letter in huge font. Require a POPLA code in the event that your appeal is rejected.

I'd appeal on the basis that:

#1 The signage is deficient (it almost certainly is, but a picture would help).

#2 You did not "park" there. You stopped for just long enough to try and decipher their deficient signage.

#3 You decided not to accept the terms on the deficient signage. Therefore no contract was or could have been formed.

Don't go into any other detail, don't try and claim any mitigating circumstances (POPLA won't consider them).

Enjoy it, don't stress. You'll win easily, if you play the game.

Out of interest would it be worth going to the petrol station today and speaking with the owners? I pass it on my way home everyday.
