Further to what carvell says, you want the garage to make a note of the registration when you're booking the MOT or repair work. So in the unlikely event of you getting pulled whilst on you're way there, you can confidently says "srsly, call them and check" when plod is pissing themselves laughing at your claims that you're just on your way to get it done.

Vehicle Excise and Registration Act 1994 Schedule 2 S22

The Law wrote:

22(1) A vehicle is an exempt vehicle [for VED purposes] when it is being used solely for the purpose of—

(a) submitting it (by previous arrangement for a specified time on a specified date) for a compulsory [MOT] test , a vehicle identity check, a vehicle weight test or a reduced pollution test, or

(b) bringing it away from any such test or check.



As regards driving without a valid MOT (which just means one issued within the appropriate period for your vehicle, e.g. a year), that's The Motor Vehicles (Tests) Regulations 1981 (as amended) S6 (2). I'll highlight the significant bits.

The Regulations wrote:
Secretary of State hereby exempts [from MOT requirements] the use of a vehicle—

(a)(i) for the purpose of submitting it by previous arrangement for, or bringing it away from, an examination, or

(iii) where a test certificate is refused on an examination—

(A) for the purpose of delivering it by previous arrangement at, or bringing it away from, a place where work is to be or has been done on it to remedy for a further examination the defects on the ground of which the test certificate was refused; or

(B) for the purpose of delivering it, by towing it, to a place where the vehicle is to be broken up;


Which is a bit contradictory. Can you "[bring] it away from" a failed test (when your previous MOT has expired), or can it only be "[delivered] to" a remedial workshop (or broken up)?

Blackstone's Policing manual does explicitly say that you can do either, but I wouldn't necessarily rely on that as a defence.
