Hey, just a quick one.
Lad has just started at my work, has his sx50 stolen a month ago and is insured with MCE.
He was staying at a friends house, where it was stolen from overnight. MCE say because he wasn't at his usual address it's not covered, but surely it's under sdp usage? They are refusing to entertain the claim at all.

Anyone shed any light on where to proceed?

Isn't it a standard procedure, of putting the complaint in writing to them, requesting their final decision (letting them know you will be taking it to the Ombudsman if they reject the claim) - and then, if they do, taking in to the insurance ombudsman for their decision?

Any significant exclusion like that would need to be made clear and plain at the outset.

What do the docs say?

What is their official repudiation rationale? Have they specified the policy exclusion or endorsement wording they are relying on?

If you give me the details I'll look at it for you

Sorry I can't be of much help but, that sounds ridiculous grounds on which to reject a claim.

They're basically saying that you have to return home at night time with your bike otherwise your insurance is void? Laughing I'd like to see where the lads policy states this. We'd have been screwed if our bikes got stolen on the Wales camping trip then. Seems like utter nonsense to me.

Sounds like he needs to get onto the insurance regulator/ombudsman or whatever they're called. I'd be surprised if he didn't win.

It's much more common than you think.

I have seen some exceptionally badly worded Garaging Conditions - which would exclude theft altogether unless in a garage despite that not being the intention

I havent got the full details of his policy, but will get them. I checked my own tpft docs and there's nothing about it. It does seem ridiculous, and he seems to have just accepted it. Was worth about 2k he said, so definately worth pursuing.

That's a very standard condition on a lot of insurance, especially for kids - and more so when it's supposed to be garaged at the home address and so on.

Presumably it's common for bikes to be stolen in such situations as they're more exposed and so on.

Mine has to be garaged overnight if it's within a mile of my home. Could it be something similar to that?

Mine has to be garaged if within half a mile of my house, and even then if not its just that the theft excess doubles, they don't chuck it out all together.

I don't recall any similar type of stipulation in my policy although, it's a while since I read all the small print but, I'm sure I'd remember such a thing. Maybe it's because mine's insured for being left on the road overnight anyway.

It seems a pretty lousy trick for the insurance company to pull though but, then again, not surprising. Though I must say that my insurance, which is through Hiscox, have always been great.

While, again, MCE seem to be a load of shisters - I can see the reasoning for this sort of things - for a start, it stops high risk people insuring the bike for a 'safe' postcode in a sleep home-counties postcode, but actually living in a scummy London urban area.

1st off. MCE are NOT the insurance company. They are just a broker...

Next now just how far away was his mates house from where he lives. How often does he stay there and what did he say to the Ins co on the claim....
