A few weeks back I had picked up Lozzy from work and was taking her home on the bike. After crossing Blackfriars a car decided to change lane into us. Now this is a nightmare for insurance claims as its hard to prove what happened but luckily I have a camera on my bike which shows he didn't indicate, ignored my horn and just drove into us.

So I sent him a letter within 24 hours with a link to the video stating he had 14 days to agree to pay or supply his insurance details to which he has failed to respond.
I have now handed this over to a claims company and the claim will now rise from a few hundred to respray a pannier lid to over a thousand with bike hire and costs.

So why when bang to rights is this driver hiding his head in the sand?

Sometimes people think that by ignoring it, they'll make it too much trouble to follow up. It's like the old PPC 'charges', they'd send you a few threatening letters, but it used to be the case that if you ignored them enough, no further action would be taken.

You're only a bloody biker, it's not like you can make a claim against a person.

Reported it as a failed-to-stop to the rozzers?

Genuine question. Obviously I didn't see the incident.

You sounded your horn. Therefore you knew the driver was intending to move into your lane regardless of him indicating or not. It also took thinking time. Why did you not also adjust your speed so he didn't hit you?

I'd like to hope you didn't just ride along being in the right while sounding your horn. Maybe you were stationary?

I'm also curious as to why you didn't take any evasive action? Braking / swerving? What kind of road did it happen on.

In my experience depends when car moved and what else around..

Car went to go into my lane on motorway once. I was overtaking, 3rd lane and alongside (so perhaps moved into his blind spot, a shoulder check would have seen me). I didn't think I had enough oomph and space to accelerate. I figured if I braked it wouldn't be quick enough (also iffy if I lost it) then he'd still side swipe me. So horn it was while moving as far right as I dared. I guess he got message/saw me as didn't continue the manoeuvre.

Will wait for sickpup to elaborate more on the position/traffic situation.

The central reservation and no time to look behind meant no evasive action. In my experience it is better to hit the car causing the incident than hit a car behind that was innocent and then have them rightfully make a claim against you.
So yes I did ride along sounding my horn knowing I was in the right, when he continued the manoeuvre knowing he was going to hit me, knowing I wouldn't cause as little danger as possible to vehicles behind and knowing it was all on camera, your point?

He's probably ignoring you - stalling - but asking around for help to get him out of the situation. He might have been advised not to respond?

I had a similar incident on M25 the other day, I was in middle lane overtaking a lorry, I was more or less along side his cab when he suddenly swerved into my lane, saw me there - then honked at me for aaages...I dunno what he expected me to do, there was a car in the outer lane over taking me. I was legally in the right...he clearly had a poor observation moment, but blamed me!! Rolling Eyes

If you've got decent video evidence then get a form F966 (Collision Incident Form) from the police and let them prosecute him.

Granted that I wasn't there but I'm pretty sure that what you should have done was knock it down a gear and wheelie past, kick his wing mirror off and throat punch him through the window.

While screaming "Go cry to your mum".
