So I got caught speeding awhile back and was "awarded" with 6 points and a hefty fine. Fair enough. I paid my fine off in two parts (around Christmas, awesome!).

On the licence side... I was in the midst off moving house when I got the letter and couldn't find it. I knew it was there somewhere. My original date to send it back was mid December. I rang up and explained my situation and they then said they would grant me until the 5th of January to receive my licence.

I did find it eventually but not till after Christmas. I ended up pudding it on the 3rd for next day delivery recorded.

Got home on Thursday to a letter dated the 7th of Jan saying because they haven't received my licence that it is now revoked as of the 10th of January. Clearly I thought royal mail fucked up. Looked online to track it but the website said "can't find any details, we went have any details until it reaches the depot". Furious, I rang royal mail to ask Wtf went wrong, to be told that it was delivered at 0647 and signed for by a certain guy. And the reason the online tracking was showing that message was because the delivery driver pressed the delivered button twice or something...

Rang the dvla up with this info to be told that they haven't received it, and when I corrected them and told then what royal mail told me, they went to "it can take 3 weeks to process". It doesn't matter when they receive it, it's when they process it. And considering it can take 3 weeks to process, the fact that even if I posted it then I could still be having this issue!

Letters always said, received by a certain date. Lay on the phone said received by a certain date. They have received it. They just haven't processed it. Yet I have proof from royal mail that they have received it. They always mentioned it can take 3 weeks to get my licence back which is fine. They never mentioned 3 weeks to "process" as in put the points on.

Where do I stand in this? I'm self employed so if I don't work I don't get paid and public transport doesn't work to the jobs I need to go to in the time scale that I have.

It's obviously important enough for you (with work etc.) to at least get a free consultation from someone who knows what he is talking about.

I don't know enough even to make any helpful suggestions.

If your licence has now been revoked, and I presume revoked means you have no licence whatsoever, You are going to have to prove they shouldn't have revoked it in the first place.

You aren't going to do that without going to court I would have thought.

Did you ever get that in writing?

Did you record the call?

Have you asked them for a copy of that conversation? Phrase it as a 'subject access request'.

This !
The useless twats will deny any knowledge of you having made contact.
You might have a slim bit of hope of they record calls at their end

Don't have a record or anything, but they do, as both times I rang them they said about the previous conversation and having until the 5th...

One thing I haven't mentioned is that once they process my licence, I'll have my entitlements back. So I will get my entitlement to drive/ride back regardless, it is just a question of when. Which is why I'm so infuriated, they says said received. Not received and processed!

I was going to speak to the local cop shop but they're closed on Sundays and Mondays....

And again, do you have any record of that, if they've chosen to forget it?

not that im condoning this but my brother got pulled over a few years back and checks showed his licence had been revoked for the same reasons. I think he had been driving around for about 18 months with a revoked licence or something stupid.

Anyway the officer believed the reasons why and kind of did the "im going to drive around the block, you should walk home but if the car is gone when i come back i wont pursue it" (made me laugh because i was a copper at the time). My brother said how nice he was and i laughed and pointed out it meant a lot of paperwork for the officer if he went through the motions (well about 2 hours of paperwork anyway).

The reality is you cant drive until your licence is back in your hand or at least valid on the PNC.

Theoretically driving otherwise in accordance and no insurance etc..

Feel for you but can be very risky if something else were to happen i.e. in an RTC or pulled over.
