Ebay buyers??

Hi all got a problem I sold my maxi scooter last week for £250 less than what I wanted. The guy who bought it very kindly gave me the money up front via electronic fund transfer before getting the bike picked up by a bike transporter person. I gave the bike a good wash & wax & cleaned the plastics. I also (out of my greatly reduced sale price) bought a new set of front brake pads out of the kindness of my heart & had them sent directly to the new owner. I have now since had an email from said buyer exclaiming his unhappiness. He claims the bike arrived filthy, "it looks like you've ridden the bike through a field" was his words & apparently the bike has developed an oil leak & the number plate fell off. I'm just wondering where I stand legally. I did put on the bill of sale "sold as seen with no warrantee given or implied". Unfortunately being unemployed I've already spent a good deal of the money paying bills so I'm not in a position to offer a refund & get the bike back. The oil leak bit I don't believe as the engine in that bike was as tight as a nuns cunt I can't explain the number plate. Any thoughts?

As long as you mean bank transfer then tell him to go use the leaked oil to lube up, then bite down on the brake pads, while ramming the number plate up his arse.

if by bank transfer then you don't need to do anything

do paypal do buyer protection on vehicles?


was the bike in the open on the transporter or in a van? roads are mucky places to be at the moment with spray thrown up by anything passing along it.

It went in the back of a long wheel base transit so it was inside.

Move on and wait for the dispute.

I get this all the time when selling scooters. Ebay will put it in your favour as the bike was sold as seen. They tell me this every time a dispute is opened and every time I win.

There won't be a dispute as although the initial contact was made through eBay the deal wasn't done there, it was a classified ad.

He's a chancer and is only after money. You've got nothing to gain by discussing the matter, so make at most one single brief factual statement by email, then cease all communication. Block, ignore, don't let yourself get wound up by it or sucked into his delusions.

Paypal/ebay guarantees etc don't work for vehicles I thought anyway?

I thought the common course of action now was sign the buyer up to call-backs for free incontinence pads and so on!

I know you didn't take paypal but this is why I want cash on collection. Too many c@nts trying to fook you over.

If you had taken paypal it may have been a problem but since it was a bank transfer I would say just ignore him.

Got to say I don't understand why you bought him a set of brake pads unless it was agreed in the sale or you already had a set? Save your money, you won't get rewarded for it.

Because human decency? I've done oil changes and chain maintenance on the bikes I've sold, thrown in spare bits, even put a tenner inside the Haynes that went with the GPZ500 to cover a part that had dropped off between sale and collection.

That was for buyers-in-person though, I'd be wary about selling remotely - although it's money in the bank at the end of the day.

When using Fleabay, Gumtree etc, etc I recommend taking pictures of everything you sell before you send it. Make sure it's date stamped, if you want to be absolutely water tight, take a picture of whatever your flogging next to the days newspaper.

Then if there is some kind of dispute, you simply forward the pics, no text just 'Rofl' in the subject field. Cool

Then throw the money you received in the air and spin around with your arms open as it rains down on you in slow motion (laughing manically is optional).

Because they looked to be getting low & as Rogerborg says out of decency. I do feel like I've been kicked in the bollocks a bit.

Do not feel bad as if you have done this person an injustice.
There are people out there who will try and take you for a ride just for their own monetary gain.
They are the ones giving you a hard time trying to extort money from you.
If all was well when you sent it off and they are coming up with a huge list of unlikely problems, chances are they are just trying you to get money out of you and you should not feel bad about ignoring them.

If you sent them a Clap Trap and they were expecting the world then thats a different matter but it sounds like someone just taking you for a ride in this case.

The pads, a kind gesture, good for you on that one. Shows you're a decent person. Could be what made the buyer think you would be a soft touch and refund some money if he hassled you enough.

Just recently, I have noticed a few of the sellers I buy from, eBay and others, have started taking photographs of the items I have bought, and send them to me by email as confirmation.

For example, Pic 1 will be the actual item next to the sales invoice. Pic 2 will be the packaged item, showing the condition of the packaging and the address lable. Pic 3 will be the item sitting on the Post Office scales.

I think this is such a good idea as a 'dispute-killer' that I am doing this myself with items I sell from now on.

In your case, I would have taken a couple of pics before the scooter was loaded onto the van, and a couple more showing the scooter being loaded, and another of the scooter in the van, strapped-down and ready to go - with the driver and reg of the vehicle in at least one of them if possible.

Then email the pictures to the buyer, and invite him to take similar pictures of the scooter as it is being unloaded, and email them back to you.

If the buyer genuinely received the scooter in a different condition to when it was loaded, you have your evidence that it must have happened in-transit (no pun intended).

Aside, I did this when the Enfield was being recovered last summer.

Driver was a bit huffy about it, but I'd already been lied to about his ability to take a card payment, so our basis for trust was on shaky foundations. It's too late to do it after he's dropped it.

I think the following happened: it fell against something whilst in transit, got slightly dirty, that's how the plate fell off, oil possibly leaked out from somewhere whilst it was on it's side, or it collected oil from something oily in close proximity. Buyer sees all of the above and thinks it was loaded like that, then vastly exaggerates the issues in his own head.

Still not your problem though.

If i was you this is how id deal with it.

eyup pal just got ya email about the scooter and tbh your talking shite send me pics of how it arrived or bring it back in person and a full refund will be given,

let him bring it back and then kindly tell him its not how he described to you and you dont want to do the refund wave politely from garden gate.

stop being a push over hes just trying his luck because he took you kindness for a weakness.
