My grandfather has just mentioned one of his old workmates has been sacked for having Viagra in his desk at work, not selling them or anything from what I can gather.

Can he go for unfair dismissal? I mean Viagra isn't illegal right.

Having sex in the workplace is a sackable offense pretty much anywhere.
That being said, House M.D/Hugh Laurie teaches me that viagra does have some medicinal uses other than for dick stiffness that is. Laughing

Difficult one to explain in the workplace either way though.

If he has a doctor's report that shows it's been prescribed for a reason other than erectile dysfunction, then yes, he can completely ruin that workplace for unfair dismissal.

If it was prescribed what is the problem? Take it as you leave work so you get home with a boner.

Pulmonary hypertension
Viagra is now marketed under the name Revatio for this uncommon but serious disorder of high pressure in the blood vessels leading to the lungs.
Mountain sickness
Viagra can reduce pulmonary artery pressure at high altitude and improve the ability to exercise in low oxygen conditions.
Raynaud’s phenomenon
In affected individuals, exposure to the cold triggers spasm of the small arteries that supply blood to the fingers, toes, or both, which become pale, cold, and painful. Both Viagra and Levitra have been helpful in clinical trials.
Heart disease
Studies suggest Viagra might help patients with congestive heart failure or diastolic dysfunction.
Further details are published in the August 2007 issue of Harvard Men’s Health Watch.

No idea why he had it but by all accounts it was a temporary thing, he was taking them home with him.

I think a previous employee was selling them a few years back so maybe the gaffers missus (not the actual gaffer) sacked him with prejudice.

So he will only have a complaint if he had a prescription then, are they illegal off prescription or something?

No, but it could be classed as an inappropriate thing to have in a workplace, since there's no valid reason for having it. I'm led to believe that workplaces have final veto over what staff are and aren't allowed to have on site, although I'm more than happy to be corrected on that.

How did his employers become aware of his possession of the medication?

If some clown was flogging blue diamonds at work I think it very possible that some other clown planted it in his draw as a joke. Take it to tribunal.

I am getting the impression that he wasn't selling the Viagra's but did have a side line of dvd's and cash in hand glass (he was a glass cutter) but they couldn't really prove it so sacked him for the v saying he was selling them.

Of course he can.

Whether he succeeds or not is entirely dependent on the stories that he, his employer and his co-workers will tell to the tribunal.

Since you're getting that 2nd and 3rd hand and we're getting it 3rd and 4th hand, that's about all that we can say.

You can tell him that via your granddad, so he'll hear it 7th hand.

I thought you could buy viagra from £1 slot machines in pub and club toilets..?

Either way, it's definitely not illegal.

So surely it's the same as having any other over-the-counter drug in your desk.

Seems pretty fishy to me. Really weird reason to be sacked.

I'd argue for Raynauds, especially since it's the middle of winter. Could say he'd done some reading, Viagra seemed to help so he uh... Kept it up.

Mrs stinkwheel gets sildenafil (the generic form of viagra) on the NHS for her Reynauds.

Our local doctors is a dispensing one so she goes once a month to pick up a carrier bag full (they come in packs of four). I always feel like I get funny looks off the receptionist. Laughing

If it's causing a problem, speak to your GP about it, there are various meds that can help. That said, GPs are often fairly clueless about Reynauds. If so, there is a specialist unit in the rheumatology depatrment at the Freeman hospital in Newcastle. Get them to referr you.

EDIT: sildenafil is a prescription medicine. It's not illegal to posess an unscheduled prescription medicine without a prescription but it is very illegal to supply them.

That's not Viagra, that's a blue tic tac sold to gullible punters who think you can buy prescription quality medication from a pub toilet.

How long has he been working there? How hard is it for him to get another job?

Tribunals are not easy to win as they tend to side with the employer and even if he wins how much money does he expect to get out of it?

I've done a tribunal and all I got was my redundancy money out of it minus 1/3 for lawyer fees.

The decision from the judge was because I got sacked for something based on an unwritten rule then they could not sake me without notice so I got redundancy.

I know it cost the company a lot which made me feel good, but for purely financial reasons it was a lot of hassle for little reward.
