after my accident in august the company that picked up my bike (4th dimension) had my documents so they could be checked against the numbers on the bike

when they wrote it off they told my wife that nothing needed to be done and they would foward the v5 to the dvla

last month we had a letter saying thet someone had applied for the v5 again (not sure how as the bike was a total write off )

we sent them a letter explaining what had happend with the addresses of the companys involved

today i have a letter saying because they were not told i have a fine
bribe of 55 gbp

Bike written off, taken to recovery depot, sold to salvage yard with no V5, V5 applied for most likely.

Just reply and say bike was recovered this date, was signed over to recovery company after accident.

When the insurance arranged to pick up my bike after my accident they didn't ask for any paperwork. Just one key and the bike is all they needed. I've had confirmation that the bike is a write-off but have not been asked to submit any paperwork following this either.

I'd forward the bribe to the insurance rep who dealt with it.

i got this with a car.

Car smashed up and recovered by recovery company. Tax disc sent back to me.

Letter from DVLA asking if i was still the owner (even though i sent the V5 to insurance company expecting them or the salvage company to fill it out Rolling Eyes ).

Basically they wanted to export the salvage abroad (probably china).

After i informed them i didnt own it anymore i got a letter with a fine.
Couldn't be arsed to write in to appeal it as i could just pay half price there and then. Decided my time i would have used appealing it was worth more than the money they were asking for.

live and learn.

emailed the insurance comp and the company that picked up the bike so see what happens if nothing by the morning phoncalls will be made

got til the 23rd to pay the half priced bribe if i dont seem to get anywere

So you hear-say now.

Thing is, it was your responsibility to tell the DVLA about the disposal of the bike, not theirs, nor anyone else's.

How many times? Brick Wall "Write off" means nothing. It's a phrase that insurers bandy about to reduce the future value of a vehicle that they've already paid out on once.

They bought the bike from you and sold it to someone else, as they were perfectly entitled to do. Having never been the registered keeper, they committed no offence, at least one that the DVLA will be interested in prosecuting.

You sent them a written confession. I bet you even signed it. Doh!


I am genuinely sorry that you were honest and decent and reasonable, and that you fu​cked up and trusted people who are none of those things, but there we are.

You may have a civil case for breach of contract with 4th dimension, if you can show that you had any contract with them or that they owed you a duty of care. But that's between you and them, not the DVLA. DVLA have you banged to rights.

Options:

Arrow Pay the bribe and try to wring the money out of someone else.
Arrow 'Remember' that you send them a notification (but you didn't, and you've told them that you didn't).
Arrow Appeal to their compassion or common sense (bwah hahahahah).
Arrow Ignore it and hope that they don't prosecute (but they have your confession).
Arrow If they prosecute, either offer a bribe at the door, or tell the magistrates that while you did indeed admit to committing the offence... uh... hang on... something will come to me...

Best option would be provoking Putin into nuking Swansea, but short of that, I think that given the circumstances I'd pay up (now or at the courtroom door) and chalk this one up to costly experience.

The insurance company have agreed to pay the bribe I had to pay

Sending me a cheque for 50 quid

I only paid 35 as paid quickly
